Description:
Deliveries of light fuel oil for the needs of the Provincial Police Headquarters in Łódź and its subordinate units

1. The subject of the contract is the supply of light fuel oil for the needs of the Provincial Police Headquarters in Łódź and its subordinate units

2.The contracting authority will first examine and evaluate the tenders, and then select the contractor whose bid has been rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure (Article 139(1) of the Act on Consumer Protection).

3. In view of the application of the procedure in Article 139 (1), the Contracting Authority shall not require the submission with the offer of the declaration referred to in Article 125 (1UPzp. The Contracting Authority will only request this statement from the contractor whose offer will be rated at the highest.

4. Pursuant to Article 257 (1), the Contracting Authority reserves the possibility of invalidating the proceedings.

Successive deliveries of light fuel oil for eight facilities

1. Detailed description of the requirements of the subject of the order:

Light fuel oil with a calorific value of min. 42,6 MJ/kg should have the following parameters:

• Density at 15ºC max 860 kg/m³ ;

• Kinematic viscosity at 20ºC max 6.00 mm²/s;

• Sulphur content max 0.10% (m/m);

• Ash residue max 0.01 % (m/m);

• Water content max 200 mg / kg;

• Total content of solid impurities not more than 24 mg/kg;

• Flow point max - 20ºC ;

• Flash point: min 56ºC.

2. A detailed list of places of supply and quantities of fuel oil for individual facilities is specified in Annex 2.1-2.3 (according to the part number) to the SWZ – List of boiler rooms and demand.

3. The quantities of the ordered assortment presented in individual items of Annex 2.1-2.3 (according to the part number) to the SWZ are estimated quantities used to calculate the price of the offer, which may change during the execution of the contract, but the total value of deliveries will not exceed the amount specified in the contract. The final quantity of individual deliveries of heating oil will result from the actual needs of the Ordering Party and its budget resources, and in the case of smaller needs, they may not constitute grounds for claims on the part of the Contractor.

4. The minimum value that the Ordering Party intends to realize shall not be less than 70% of the value specified in the contract.

5. The contractor shall attach to each delivery a valid fuel quality certificate, certified by the fuel manufacturer or a certificate from an accredited laboratory. The certificate with the number and date of delivery or issue should be attached to the VAT invoice.

6. Deliveries of heating oil shall be carried out on the basis of orders placed by telephone or e-mail by the Ordering Party with the Contractor on working days (working days mean weekdays from Monday to Friday from 800 to 1500 hours, excluding public holidays) after prior notification of the Ordering Party by the Contractor about the date of delivery, at least one day in advance.

7. The Contractor is obliged to ensure transport with unloading of fuel oil with means adapted to this in accordance with applicable law. These means of transport shall be equipped with legalised flow meters indicating the quantity of fuel dispensed.

8. The Ordering Party allows the possibility of supplying fuel oil to other facilities (not listed in Annex 2.1-2.3 (according to the part number) to the SWZ - List of boiler rooms and demand in the case of commissioning of new facilities during the term of the contract, or replacement of the boiler room with oil during the term of the contract.

In the above case, the value of the contract will not change.

9. The settlement of each refueling will be based on the amount of oil actually refueled (according to the flow meter). The order will be considered completed when the oil is pumped into the Ordering Party's tank and confirms the quantity and type of order.

10. A detailed description and conditions for the performance of the contract are set out in the model contract constituting Annex 10 to the SWZ.

11. The Contractor shall be entitled to remuneration for the delivered oil constituting the product of the unit price of 1 litre of fuel oil on the date of delivery of each batch of goods according to the current refinery's price list and its quantity, applying a fixed discount from the offer and increased by the applicable VAT rate.

12. The unit price of fuel for each delivery may not exceed the product of the price of PKN ORLEN S.A. fuels. on the day of delivery (if the price has not been announced on that day, then from the preceding day) and the Contractor's price coefficient.

The price coefficient is the quotient of the price of fuel offered by the Contractor and the net wholesale price of fuels in rail deliveries and tank trucks of the fuel manufacturer on the domestic market of PKN ORLEN S.A. published daily on the website
