1. The subject of the contract is the provision by the Contractor to the Ordering Party of maintenance services and technical assistance in the field of Cisco devices in accordance with Appendix No. 1 to the Draft Agreement, constituting Annex 3 to the SWZ.
2. The service of service and technical assistance, hereinafter referred to as the service, shall be understood as all activities – including remote actions – necessary to remove the defect in hardware or software and restore to technical efficiency in accordance with the parameters guaranteed by their manufacturer, taking into account normal wear and tear of the equipment.
3. The service period for devices is a minimum of 36 months.

3. The service period for devices is a minimum of 36 months.
4. The service must be authorized by the manufacturers of the equipment, i.e. repair or replacement of the equipment or parts thereof with new and original parts must be provided in accordance with the methodology and recommendations of the manufacturer.
5. The scope of the contract includes:
a) service-desk service, under which the Contractor will provide the opportunity to report errors and faults via telephone and e-mail,
b) provision of consulting services (e.g. assistance in configuring new services, expansion) by a person with experience in the design and implementation of LAN/MAN/WAN networks, holding a current CCIE Switching & Routing certificate or CCIE Security certificate,
c) repair or replacement of devices that work incorrectly or have been damaged for efficient, free from defects, with technical and quality parameters not worse than the device to be replaced, listed in Appendix No. 1 to the Draft Agreement,
d) reconstruction after removing the failure of the device configuration as it was before the failure, the software configuration of the device shall be provided by the Ordering Party,
e) if the Contractor is unable to repair, he will be obliged to provide equivalent devices installed in place of the damaged ones,
f) defects should be removed in accordance with the order of notifications, with the proviso that the Ordering Party may change the priority of the defect,
g) conducting tests after each repair, carried out by the Contractor with the assistance of the Contracting Entity, in order to confirm the correct operation of the devices and restore full functionality.

5) a copy or information from the National Court Register or from the Central Register and Information on Economic Activity, within the scope of Article 109 paragraph 1 point
6) the Contractor's statement on the validity of the information contained in the statement referred to in Article 125(1) of the PPL, with regard to the grounds for exclusion from the proceedings indicated by the Contracting Authority, referred to in:
a) Article 108(1)(3) of the PPL Act,
b) Article 108(1)(4) of the PPL Act, concerning the prohibition of applying for a public contract as a precautionary measure,
(c) Article 108 (1) (5) of the Pzp Act concerning the conclusion of an agreement with other Contractors to distort competition,
(d) Article 108 (1) point 6 of the Pzp Act,
(e) Article 109 (1) (1) of the Pzp Act, as regards the breach of obligations relating to payment of local taxes and fees referred to in the Law of 12 January 1991 on taxes and local levies (Journal of Laws of 2019, item 1170),
7) information from the Central Register of Beneficial Owners, if separate regulations require entry in this register, prepared not earlier than 3 months before its submission.
If the Contractor has its registered office or place of residence outside the Republic of Poland, instead of the documents referred to in section VI.3) point 3. item 1), 3) - 7) announcements - it submits the documents specified in § 4 of the Regulation of the Minister of Development, Labor and Technology of 23 December 2020 on subjective evidence and other documents or statements that the contracting authority may request from the contractor (Journal of Laws of 2020, item 2415).
