The subject of the contract is the delivery of 1 (one) low-floor city bus with hydrogen drive, single-unit, with a length of 11.5 – 12.5 m, intended for public transport. The offered bus will be brand new, which means that it will be produced no earlier than 6 (six) months before the date set in accordance with point 4 of the SWZ and with a mileage according to the odometer of not more than 500 km.

The subject of the contract is the delivery of 1 (one) low-floor city bus with hydrogen drive, single-unit, with a length of 11.5 – 12.5 m, intended for public transport. The offered bus will be brand new, which means that it will be produced no earlier than 6 (six) months before the date set in accordance with point 4 of the SWZ and with a mileage according to the odometer of not more than 500 km.
The subject of the contract includes the granting by the Contractor to the Ordering Party of a partial (internal) authorization or authorization for the entire vehicle, to perform maintenance and repair works of the offered type of vehicle along with training of the Ordering Party's employees in the field of ongoing operation and repairs of the bus (electrical, mechanical and bodywork). If the Ordering Party is unable to perform repair work on its own, it will ask the Contractor or the Authorized Service Station indicated by the Contractor for assistance in carrying out the repair, during the warranty period and outside this period.
The subject of the contract includes free training of the Ordering Party's employees (drivers, electro-mechanics and technical staff) in the field of economical driving, service and repairs at the time and place agreed with the Ordering Party.
The subject of the contract includes the provision by the Contractor to the Ordering Party of a guarantee for the supply of spare parts for the delivered bus for a minimum of 15 years from the date of delivery of the bus.
The subject of the contract is implemented as part of the project entitled "Hydrogen buses for Konin – Green City of Energy" under Measure 11.4 "Urban Transport", co-financed by the Operational Programme Infrastructure and Environment 2014-2020.
The offered bus must meet all the requirements set out by Polish laws and standards, in particular:
a) have documents allowing its registration and operation in Poland,
b) have as at the date of submission of tenders a current "Vehicle Type Approval Certificate" issued by a statutory authorized body within the meaning of the provisions of the Regulation of the Minister of Transport and Maritime Economy of 25 March 2013 on type-approval of motor vehicles and trailers and their items of equipment or parts (consolidated text Journal of Laws of 2015, item 1475),
c) meet the requirements set out in the provisions contained in Section III of the Act of 20.06.1997. – Road Traffic Law (consolidated text, Journal of Laws of 2022, item 988).
d) meet the requirements set out in the Regulation of the Minister of Infrastructure of 31.12.2002. on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text Journal of Laws of 2016, item 2022, as amended),
e) meet the requirements of Regulation (EC) No 79/2009 of the European Parliament and of the Council of 14 January 2009 on type-approval of hydrogen-powered motor vehicles and amending Directive 2007/46/EC,
f) meet the requirements of Commission Regulation (EU) No 406/2010 of 26 April 2010 on the type-approval of hydrogen-powered motor vehicles,
g) must meet the technical parameters and requirements specified by the Ordering Party in point 11.4 of the SWZ).
The contractor is obliged to:
a) provide a guarantee on the terms specified by the Ordering Party,
b) grant the Ordering Party an unlimited in time and free of charge license for all software of devices equipped with the bus together with the software functionality unlimited in time,
c) deliver the subject of the order to the Ordering Party's headquarters on the terms of DDP according to Incoterms 2010.
