The subject of the order is a comprehensive delivery of high-methane natural gas with the symbol E, covering the sale and provision of distribution services in the period from 1.1.2020 to 31.12.2020 for the needs of facilities in the Territorial Self-Government Units: Brzostek commune 39-230, Biecz 38 commune -340, Black Commune 39-215, Commune Dębowiec 38-220, Commune and Town Jasło 38-200, Commune Jedlicze 38-460, Commune Jodłowa 39-225, Commune Town Kołaczyce 38-216, Commune Nowy Żmigród 38-230, Commune Osiek Jasielski 38-223, Commune Pilzno 39-220, Commune Sękowa 38-307, Commune Skołyszyn 38-242, Commune Szerzyny 38-246, Commune Tarnowiec 38-204, Commune Town Grybów 33-330, District Jasielski 38-200 Jasło and Gorlice Poviat 38-300 Gorlice together with organizational units and cultural institutions.

2. Annex No. 4 to the ToR describes a summary list of natural gas demand by entities and tariffs. The Ordering Party, after selecting the Contractor, will submit the documents for the notification of the sale and distribution services agreement and updated necessary data in the editable version - Excel file.

3. The values of natural gas consumption indicated in Annex 4 to the ToR shall be used to calculate the estimated value of the contract, which does not reflect the actual use during the term of the contract and in no case may be grounds for any claims on the part of the Contractor.

4. The total estimated consumption of gaseous fuel [kWh] in the period from 01.01.2020 to 31.12.2020 is 40 456 723,42 kWh.

5. The material scope of the subject of the contract covered by the present proceedings is defined by a detailed description of the subject of the contract - Annex No. 4 to the Terms of Reference - containing the locations and description of gas fuel collection points. The supply of gaseous fuel for individual collection points covered by the public procurement will commence in accordance with the time limits set out in Annex 4 to the ToR and not earlier than on the day of effective termination of the existing comprehensive gas fuel supply contracts and also after the positive switching procedure of the System Operator distribution.

6. The Ordering Party foresees in the exercise of this order the option right based on Art. 34 par. 5 Public Procurement Law. By means of the option option, the Ordering Party understands the possibilities of fulfilling the contract in a wider scope than specified in the present proceedings. The option right is the Employer's right which he may or may not use as part of the performance of this contract. The right of the option will consist in increasing the volume of the ordered natural gas up to 10% of the quantities indicated in Annex 4 to the ToR by submitting a relevant order by a given Ordering Party.

7. The subject of the contract also includes:

a) termination on behalf of the Employers of existing comprehensive contracts for the supply of gaseous fuel in accordance with Annex 4. The above obligation is on the Contractor throughout the duration of the contract (eg the introduction of new collection points, referred to in point XXVI of the Terms of Reference). The Contractor is obliged to submit a scan of the termination notice to the Union of Wisłoka River Basin Communes immediately after its submission, to the e-mail address: zamowienia@wisloka.pl

b) reporting to the appropriate Distribution System Operator for the execution of the contract concluded with the Contractor,

c) immediately informing the Proxy at email: zamowienia@wisloka.pl about the negative process of changing the seller (rejection of the sales contract notification) for a given collection point,

d) provision of the comprehensive high-methane gas supply service with the E symbol in accordance with the applicable provisions of the Energy Law of 10 April 1997. (consolidated text, Journal of Laws of 2018, item 755, as amended).
