Description:
MANAGEMENT OF MUNICIPAL WASTE FROM REAL ESTATE RESIDING IN THE MUNICIPALITY OF ŻAGAŃ WITH MUNICIPAL STATUS AND FROM THE POINT OF SELECTIVE COLLECTION OF MUNICIPAL WASTE

The subject of the contract is the provision of a service consisting of the development of non-segregated (mixed municipal waste) and segregated municipal waste from real estate inhabited in the Municipality of Żagań with municipal status and from the Selective Collection of Municipal Waste in municipal installation

or installation of waste recovery and disposal. The Contractor shall carry out the order in accordance with the provisions of the law, in particular:

a) the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2023, item 1587, as amended),

(b) the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities

(i.e. Journal of Laws of 2023, item 1469, as amended).

The Contractor shall be obliged to use the following fractions of municipal waste with codes:

• 20 03 01 - Unsegregated (mixed) municipal waste,

• 15 01 01 - Paper and cardboard packaging,

• 15 01 01 - Paper and cardboard packaging (contaminated),

• 15 01 07 - Packs of glass,

• 15 01 07 - Glass packaging (contaminated),

• 15 01 02 - Plastic packaging,

• 15 01 02 - Plastic packaging (contaminated),

• 20 01 10 - Clothing,

• 20 01 11 - Textiles

• 20 01 40 - Metals,

• 20 02 01 - Biodegradable waste,

• 20 02 01 - Biodegradable waste (contaminated),

• 20 03 07 - Bulky waste,

• 16 01 03 - Worn tyres,

• 17 01 01 - Concrete waste and concrete rubble from demolitions and repairs

• 17 01 02 - Brick rubble

• 17 01 07 - Mixed waste from concrete, brick rubble, waste ceramic materials and equipment elements other than those listed in 17 01 06

• 17 09 04 – Mixed construction, renovation and demolition wastes other than those mentioned in 17 09 01, 17 09 02 and 17 09 03.'

Municipal waste will be transferred successively for its management

in quantities depending on the amount of waste generated in the city of Żagań

collected by the entity providing the service of collection and transport of municipal waste

from the area of the Żagań Municipality with urban status. Waste subject to the obligation to be managed in a municipal installation may only be managed by

in the municipal installation.

The Contracting Authority requires the Contractor to ensure the performance of the contract for the management of non-segregated (mixed) municipal waste using a municipal installation for the treatment of waste covered by the subject of the contract, indicated on the list referred to in Article 38b(1) of the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2023, item 1587, as amended).

If the municipal installation operated by the Contractor and indicated in the offer

will not be able to accept waste during the performance of this contract, the Contractor is obliged to indicate another municipal installation that will accept municipal waste at the Contractor's expense within the same period as its delivery

to the Contractor. In this situation, if it is necessary to transport municipal waste to another installation at a distance from the Żagań Municipality with urban status greater than the distance of the Contractor's installation, the Contractor will cover the difference in costs resulting from the need to transport municipal waste over a longer distance.

The Contractor shall notify the entity that will deliver waste to the Contractor for management under this contract of the fact that it is not

able to accept waste, and will indicate to that entity another municipal installation and the days and hours of its acceptance of waste at the latest on the first day of the period in which it will not be able to accept waste.

The Contractor shall inform the Contracting Authority of any failures of the installation, downtime in waste collection, changes in the operation of the installation, restrictions resulting from the decisions of supervisory authorities within 24 hours from the moment of the occurrence of events, limitations, downtime.

The Contractor undertakes to accept waste for the municipal installation on working days from Monday to Friday from 6:00 a.m. to 9:00 p.m. (except for public holidays).

The municipal installation should be equipped with a drive-on scale. The Contractor will confirm each delivery of waste in the BDO system.
