The subject of the contract is the development of the Ordering Party's server infrastructure (hereinafter referred to as the "assortment"). The Contractor will deliver and install the assortment in the indicated rack cabinets in the Ordering Party's server room located in building B, at al. Niepodległości 12 in Poznań.

The Contractor will deliver and install the assortment in the indicated rack cabinets in the Ordering Party's server room located in building B, at al. Niepodległości 12 in Poznań.

2. The scope of the subject of the contract also includes:

- granting the guarantee and performance by the Contractor of the services resulting from it. Detailed

the requirements for the guarantee are set out in the draft contract constituting Annex 9 to the SWZ.

The Contractor is the Guarantor for the Ordering Party, but this does not release the Contractor from the obligation to provide warranty, license, technical support, etc. documents. the manufacturer of the range offered, if any, supplied by him with the equipment.

3. Equipment supplied must comply with the conditions of the CE marking and bear the latter mark.

4. The assortment which is the subject of the contract must come from official distribution channels covering also the European Union market, ensuring in particular the exercise of warranty rights.

5. The Contractor guarantees that the assortment offered by him, which is the subject of the contract, is legally placed on the market and use in the European Union.

6. The subject of the order must be brand new, i.e. not used before the date of delivery - excluding the use necessary to carry out the test of its correct operation.

7. The assortment must be provided with accessories, manuals and other elements necessary to run it in a configuration consistent with the requirements and minimum parameters specified in the technical and price specification constituting Annex 2 to the SWZ and, if applicable to a given assortment, a full list of consumables with marked warranty periods and prices.

8. The assortment intended for power supply from the power grid must be equipped with an appropriate number of power cables to allow it to be connected to standard power outlets, unless otherwise specified in the technical and price specification.

9. The Contractor guarantees that the offered assortment will have a service of the manufacturer of this equipment, with service service conducted in Polish.

10. The Contractor's price offer must include all costs related to the implementation of the subject of the contract in accordance with the requirements of the SWZ, including m.in costs of delivery of the subject of the contract to the Ordering Party's headquarters, insurance for the time of delivery, service inspections and technical support in accordance with the Contractor's offer. Therefore, the Contractor will not be able to demand from the Ordering Party to cover any additional costs related to the implementation of the subject of the contract.

11. The Ordering Party reserves the right to verify the delivered assortment as part of the implementation of this order, in terms of the legality of the origin and other statements of the Contractor.
