The subject of the contract is services in the field of forest management as defined in Article 6 (1) point 1 of the Act of 28 September 1991 on forests (text one: Journal of Laws of 2021 item 1275 as late as “Forests Act”) covering works in the field of forest breeding and protection, fire protection, tourist development, ongoing maintenance of forest roads and melioration facilities, harvesting and plucking of timber, to be carried out in Trzebielino Forest District in 2022.
The proceedings shall be carried out in accordance with the rules laid down for the so-called 'reverse procedure' referred to in Article 139 (1), (3) to (4) of the PZP.
1) The subject of the contract is services in the field of forest management as defined in Article 6 (1) (1) of the Act of 28 September 1991 on forests (text one: Journal of Laws of 2021 item 1275 as late as “Forests Act”) covering works in the field of forest farming and conservation, protection of the forest fire protection, tourist development, ongoing maintenance of forest roads and drainage facilities, harvesting and plucking timber, to be carried out in the Forest District Trzebielino in the year 2022.
2) The implementation of the works included in the subject of the contract for individual Packages will take place in the area of forestry — relevant for the Package in question (“Package Execution Area”). The location (forest address) of individual forestry works falling within the scope of the subject of the Agreement as indicated in Annexes 3.1. — 3.3. The location (forest address) of the individual works falling within the scope of the Subject of the Agreement shall be specified in the Order referred to in point 3.3 (1), with the provision that it will always be the Package Implementation Area.
3) Due to the actual natural weather situation, which may occur during the execution of the subject of the contract, as well as the economic and economic situation unforeseen at the moment, the Ordering Party reserves the right to make reductive adjustments, increasing adjustments, new findings location, as well as pausing the actions indicated in the individual rows of the tables describing the subject of the order. Increasing adjustments do not imply the introduction of new works not covered by the scope of the contract, and reducing adjustments do not imply a complete abandonment of part of the work. These should be understood as increasing the amount of work in one location (forest address) in the Package Execution Area (including locations in the Package Realization Area not pre-indicated in SWZ), while reducing the amount of work in another location (forest address) on Package Implementation Areas, within the framework of the total quantities of individual works falling within the scope of the Contract Subject specified in the SWZ, which are to be executed throughout the Package Execution Area. The need to increase the size of certain elements of the order in the course of execution of the object of the order may also occur in order to complete the full range of work described in the subject of the order. Determination of a new location takes place within the subject of the order, always only in the Package Execution Area.
4) In the event of mandatory exclusion of items from acquisition in the machinery system (logging at the cutting positions where it is unacceptable to use multi-operational machines) in particularly justified cases, e.g. changes in the conditions for which the above activities have been established, the Ordering Party permits a change in timber harvesting technology.
5) The Contracting Authority does not reserve any obligation to personally perform key tasks concerning the subject of the contract. The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors.
6) 3.5. The Contracting Authority in accordance with Article 95 of the PZP requires employment by the Contractor or subcontractor on the basis of the employment relationship of persons carrying out the execution of the contract involving the acquisition and ripping of wood raw material, if the execution of such activities involves carrying out the work in a manner defined in Article 22 § 1 of the Act of 26 June 1974 - Labour Code (text one: Journal of Laws of 2020 item 1320 as amended).
