The subject of the order is the delivery of electricity in the planned quantity of approximately 6,783,008 kWh in the period to December 31, 2020 for 546 collection points. The beginning of the sales start is determined no sooner than 1.1.2020.

1) The subject of the order is the supply of electricity for the needs of the entities listed in Annex 1 to the Terms of Reference, in the planned quantity of approximately 6,783,008 kWh in the period to December 31, 2020 for 546 points of collection. Detailed information on individual collection points is presented in the summary list constituting Appendix 2 to the specification.

2) The beginning of the sale start is determined not earlier than 1.1.2020.

3) Electricity consumption declared in item 1 is an approximate value and is used to calculate the offer price.

4) The subject of the contract describes the following names and codes of the Common Procurement Vocabulary (CPV): 09310000-5 Electricity.

5) The contractor must have a general agreement for the provision of electricity distribution services with the distribution system operator: Energa-Operator SA. The distribution services will be provided on the basis of separate agreements concluded between the ordering parties (recipients / payers) and the distribution system operator (DSO).

6) In Annex No. 2 in the column "Duration of the contract / contract notice period", the indicated period "31/12/2019" means that for these collection points the change of seller will take place once again and contracts for the supply of electricity are currently concluded for a definite period until 31/12/2019 (the current energy supplier for these PPE is Tauron Sprzedaż Sp. z oo with its registered office in Kraków, Łagiewnicka 60, 30-417 Kraków, POLSKA).

7) The Contractor, on the basis of the Power of Attorney granted, will be obliged to submit on their own behalf and ordering parties (recipients / payers) contracts for the sale of electricity to the relevant DSO in accordance with applicable regulations.

8) The obligation to terminate contracts concluded for an indefinite period lies with the Contractor, subject to the points of collection specified in Annex No. 2 where the contracting parties themselves terminated the contracts before the announcement of the present proceedings.

9) In case when the contracting party (recipients / payers) will not have valid electricity distribution agreements on the day the electricity sales contract is concluded or if a change occurs on the recipient's side during the contract period, the contractor will be obliged to submit applications for conclusion of distribution agreements and signing contracts on behalf of and for the benefit of awarding entities (recipients / payers) or submitting on behalf of procuring entities (recipients / payers) a statement of consent to the conclusion of distribution agreements with the Operator (as per Operator Operator IRiESD), for which the contractor will be granted appropriate Power of Attorney.

10) With regard to all collection points, the contracting entities (payers / recipients) have the status of a recipient, so they are entitled to purchase energy from the seller selected by them / art. 4j par. 1 of the Energy Law Act of 10.4.1997.
