1.The subject of the contract is the supply of electricity in the period from 01.01.2023. until 31.12.2023 - up to 3 556 PPE with a total estimated volume (+/-10%) of 37 942.55 MWh, of which:
1) For premises and facilities – tariff groups C, G, R (Part 1 of the contract) – 21 319,50 MWh – the list of PPE is Annex 1a to the SWZ
2) For premises and facilities – tariff group B (Part 2 of the contract) – 8 426.14 MWh – the PPE list is Annex 1b swz.
3) For the purposes of road lighting (Part 3 of the contract) – 8 196.91 MWh – the PPE list is Annex 1c SWZ
2. The forecast electricity consumption indicated above is indicative and may deviate from the amount of energy actually collected, during the duration of the contract. Reducing or increasing the amount of electricity does not entail any consequences for the contracting (customers), other than the need to pay for the amount of energy actually collected.
3.Applicable billing periods: Tariff group B, C2x – 1 month, tariff group C1x, G, R – 2 months
Electricity supply to premises and facilities — tariff groups C, G, R1. Number of measuring systems accounting for consumed electricity 2 299 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.
3. Estimated electricity consumption during the term of the contract – 21 319.50 MWh, of which:
Zone I 13 912,89 MWh
Zone II 6 859,22 MWh
Strefa III 547,39 MWh

4. The Ordering Party Miejskie Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o. in Choszczno will have the status of a Manufacturer, item No. 10 (PPE number: 590310600000829054) in Annex 1a to SWZ. In September 2022, the Ordering Party plans to connect a photovoltaic installation with a capacity of 50 kWp, as a result of which it will obtain the status of the Manufacturer. In this case, the contracting authority will conclude with the contractor whose offer will be selected a contract for resale and balancing of res generated in a micro-installation and unused electricity (about 0.50 MWh per year), which will be valid for the entire delivery period.
The contracting authority agrees to conclude a contract for the resale of energy on the model used by the contractor.
5. Deliveries will take place from 01.01.2023. until 31.12.2023, with the proviso that deliveries to the Drawsko Pomorskie Commune will start from 01.02.2023. Details of the delivery times for each collection point are described in Annex 1a to the SWZ column "Delivery period".
6.Existing electricity supply contracts will expire or be terminated with effect from the day preceding the planned date of commencement of deliveries (column "Delivery period"). The obligation to terminate contracts lies with the ordering parties (recipients).
7.Quality standards
1) The subject of the order is the supply of electricity with certain quality standards in accordance with applicable regulations.
2) Quality standards of electricity are described in the Pe and the Regulation of the Minister of Economy of 4 May 2007 on detailed conditions for the functioning of the power system (as amended) and the Regulation of the Minister of Energy of 6 March 2019, as amended, on detailed rules for the formation and calculation of tariffs and settlements in electricity trading.

9. The Contractor shall, on the basis of the Power of Attorney granted, be required to notify on behalf of his own and the Contractor (recipients) of the contracts to the relevant DSO in accordance with the applicable rules and to represent the Contractor (recipients) before the DSO - the process of changing the seller.
10. The contracting authority reserves the right to make use of Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating tenders, and then making a subjective qualification of the contractor whose offer has been rated the highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
11. As a result of the outcome of the public procurement procedure, 35 contracts will be concluded.
12. The contracting authority requires the provision of a security for the proper performance of the contract, the contractor shall lodge 35 securities for the proper performance of the contract, separately for each contract concluded with the contracting authorities.
13. The Ordering Party requests the lodging of a security deposit. In the case of submitting an offer for Part 1 of the order: PLN 500,000.00

The Ordering Party Miejskie Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o. in Choszczno will have the status of The Manufacturer, item No. 1 (PPE number: 590310600000830692) in Annex 1b to the SWZ, the ordering party plans to connect a photovoltaic installation with a capacity of 50 kWp in September 2022, as a result of which it will obtain the status of the Producer. In this case, the contracting authority will conclude with the contractor whose offer will be selected a contract for resale and balancing of res generated in a micro-installation and unused electricity (about 0.50 MWh per year), which will be valid for the entire delivery period. The contracting authority agrees to conclude a contract for the resale of energy on the model used by the contractor.
5. The Ordering Party Zakład Wodociągów i Kanalizacji Sp. z o.o. in Złocieniec has the status of The Manufacturer - Item No. 1 (PPE number 590243852033790163) in Annex 1b to SWZ, the ordering party from 2019 has an installation of photovoltaic panels with a capacity of 47 kWp. The contracting authority provides for the conclusion with the contractor, whose offer will be selected, of a contract for the resale and balancing of energy generated in a RES micro-installation and not used (about 0.50 MWh per year), which will be valid for the entire delivery period. The contracting authority agrees to conclude a contract for the resale of energy on the model used by the contractor.
6. Deliveries will take place from 01.01.2023. until 31.12.2023 Details of the delivery dates (start and end) for each collection point are described in Annex 1b to the SWZ column "Delivery period".
7. The measuring systems shall be adapted to the procedure of changing the seller.
8. Existing electricity supply contracts will expire with effect from the day preceding the planned date of commencement of deliveries (column "Delivery period"). For all PPE, the change of seller will take place once again.

The Contractor, based on the Power of Attorney granted, will be obliged to submit contracts on behalf of himself and the ordering party (recipients) to the competent DSO in accordance with applicable regulations and to represent the ordering party (recipients) before the DSO - the process of changing the seller.

The contracting authority reserves the right to use Article 139(1) of the Public Procurement Law, i.e. the possibility of first examining and evaluating tenders, and then making a subjective qualification of the contractor whose offer was the highest rated, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
14. As a result of the outcome of the public procurement procedure, 9 contracts will be concluded.
15. The Contracting Authority requires the provision of a security for the proper performance of the contract, the Contractor shall lodge 9 securities for the proper performance of the contract, separately for each contract concluded with the contracting authorities.
16. The Ordering Party requests the deposit. In the case of submitting an offer for Part 2 of the order: PLN 250,000.00.
Supply of electricity for the needs of road lighting1. Number of measuring systems accounting for consumed electricity 1 232 pcs.

3. Estimated electricity consumption during the contract period of 8 196,91 MWh, of which:

4. Deliveries will take place from 01.01.2023. until 31.12.2023, with the proviso that for the majority of THE EPP of the Drawsko Pomorskie Commune deliveries will start from 01.02.2023. Details of the delivery dates (start and end) for each collection point are described in Annex 1c to the SWZ column "Delivery period".

10. As a result of the settlement of the public contract award procedure, 23 contracts will be concluded.
11. The Contracting Authority requires the provision of a security for the proper performance of the contract, the contractor shall lodge 22 security for the proper performance of the contract separately for each contract concluded with the contracting authorities, excluding the contract concluded with the Świdwin Municipality.
12. The Ordering Party requests the lodging of a security deposit. In the case of submitting an offer for Part 3 of the order: PLN 250,000.00
