The subject of the contract is the collection, transport and management of municipal waste indicated in the description of the contract from properties where residents live, the so-called permanently and temporarily inhabited properties – including real estate developed with summer houses in a manner consistent with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2023, item 1469) and other provisions of law – including: Regulation of the Minister of Climate and Environment of 17 May 2021 on the detailed method of selective collection of selected waste fractions (Journal of Laws of 2021, item 906), Resolution No. XXII/405/20 of the Wielkopolska Regional Assembly of 28 September 2020 on the adoption of the Waste Management Plan for the Wielkopolska Voivodeship for 2019-2025 together with the investment plan and Resolution No. XLIII/358/22 of the Lubasz Commune Council of 29 September 2022 on the Maintenance Regulations cleanliness and order in the Lubasz Commune.

Collection, transport and management of municipal waste from 01.01.2024 to 31.12.2024 from properties where residents live (the so-called permanently and temporarily inhabited properties – including properties developed with summer houses), including:

(a) receiving non-segregated (mixed) waste;

b) collection of segregated waste: biodegradable (bio-waste), paper, metal, glass, plastics, multi-material packaging waste, with the proviso that the Contractor will collect any amount of the above-mentioned municipal waste. On the premises of permanently and temporarily inhabited properties, a mixed container and bag system for municipal waste collection will be in force:

1) unsegregated (mixed) municipal waste:

(a) unsegregated (mixed) municipal waste will be received from containers in black with a capacity of 120 litres, 240 litres, 1,100 litres from the owners of the property on which the residents reside (so-called real estate inhabited constantly and temporarily) — property owners provide in/w containers for the properties concerned and maintain them in appropriate sanitary, cleanup and technical condition,

(b) unsegregated (mixed) municipal waste will be collected from containers in black with a capacity of 120 litres, 240 litres, 1,100 litres, the property owners shall provide the abov. containers on the property concerned and maintain them in appropriate sanitary, cleanup and technical condition,

c) frequency of collection (disposal) of unsegregated (mixed) municipal waste – 1 time every 2 weeks, in accordance with the schedule made by the Contractor, agreed with the Contracting Authority and accepted by the Contracting Authority (the frequency of waste collection in multi-family housing is different, it is described further in the Terms of Reference),

(d) in multi-family housing, non-segregated municipal waste will be collected from containers — the owners (managers) of the property provide in/w containers on the properties concerned and maintain them in appropriate sanitary, cleanup and technical condition,

(e) the number of buildings (so-called permanently and temporarily inhabited properties) is given in the section concerning the characteristics of the commune of Lubasz,

f) the Contractor will be obliged to manage the collected non-segregated (mixed) municipal waste and selective waste by transferring it for recovery or disposal by the Contracting Authority (the frequency of waste collection in multi-family housing, summer houses is different, it is described further in the Terms of Reference),

(d) in multi-family housing, non-segregated municipal waste will be collected from containers — the owners (managers) of the property provide in/w containers on the properties concerned and maintain them in appropriate sanitary, cleanup and technical condition,

(e) the number of buildings (so-called permanently and temporarily inhabited properties) is given in the section concerning the characteristics of the commune of Lubasz,

(f) the Contractor's obligation will be to use the collected unsegregated (mixed) municipal waste and selective waste by transferring it for recovery or disposal in accordance with the provisions of applicable law, as well as presenting it to the Contracting Authority (once a month) evidence supporting the performance of these activities, i.e. waste transfer cards. According to the law in force, non-segregated (mixed) waste should go to a municipal plant, biodegradable waste (biowaste) for recovery or waste disposal facilities;

2) Selectively collected municipal waste (segregated waste):

(a) the collection of selectively collected municipal waste in single-family housing development will be carried out in a bag system or using containers,
