The supply of electricity will take place on the basis of a sales contract (without distribution) and will be carried out in accordance with the provisions of the Act of 10 April 1997. Energy law, Public Procurement Law, Civil Code and implementing regulations issued on their basis.

It is planned that the Municipality of Bełżyce will conclude one agreement, on its own behalf and for the benefit of subordinate units.

Part I of the contract – purchase of electricity for facilities listed in Annex 1a to the SWZ:

1) The estimated electricity demand in the period from 01.07.2023 to 31.12.2023 is 842 683.00 kWh.

2) The estimated value of the contract in the period from 01.07.2023 to 31.12.2023 is PLN 665,421.03.

3) The performance of the activities arising from the power of attorney constituting Annex 1 to the Designed provisions of the Agreement (Annex No 4.1 to SWZ), in particular the Contractor obliges the Contractor to notify the designated Distribution System Operator to implement the sales contract concluded with the Contractor electricity, the submission of statements of will and the determination on behalf of the Contracting Authority of all necessary information in the field of termination of the existing contract for the sale of electricity and the provision of distribution services (comprehensive agreement), representation of the Contracting Authority before the competent Operator of the Distribution System in matters related to the conclusion of a distribution service contract.

Part II of the contract – purchase of electricity for facilities listed in Annex 1b to the SWZ:

1) The estimated electricity demand in the period from 01.01.2024 to 31.12.2025 is 3 373 062.00 kWh.

2) The estimated value of the contract in the period from 01.01.2024 to 31.12.2025 is PLN 3,373,062.00.

3) Performing activities resulting from the power of attorney constituting Annex 1 to the Draft provisions of the contract (Annex 4.1 to the SWZ), in particular the Contracting Authority obliges the Contractor to notify the indicated Distribution System Operator to perform the electricity sale agreement concluded with the Contractor, submit declarations of will and determine on behalf of the Ordering Party all necessary information regarding the termination of the existing energy sales agreement electricity and provision of distribution services (comprehensive agreement), representing the Ordering Party before the relevant Distribution System Operator in matters related to the conclusion of the distribution services agreement.
