Description:
Supply (purchase) of electricity for the needs of organizational units of the Świdnik District and the Independent Public Health Care Facility in Świdnik in 2024

1. The subject of this contract is the supply of electricity for the organizational units of the Świdnik District and the Independent Public Health Care Facility in Świdnik in 2024.

2.A list of collection points together with relevant information on the conditions under which electricity sales services are currently provided and detailed demand for electricity is attached to the SWZ "Detailed description of the subject of the contract".

3.Estimated electricity demand for the following facilities in the period from 01.01.2024 to 31.12.2024 is 1,401,939.00 kWh.

4. The supply of energy will take place on the basis of contracts concluded separately by individual end users.

1. The subject of this contract is the supply of electricity to the organizational units of the Świdnik District and the Independent Public Health Care Facility in Świdnik in 2024.

2. A list of collection points together with relevant information on the conditions under which electricity sales services are currently provided and the detailed demand for electricity is attached as Appendix to the Terms of Reference "Detailed description of the subject of the contract".

3. Estimated electricity demand for the following facilities in the period from 01.01.2024 to 31.12.2024. is 1,401,939.00 kWh.

4. The Contractor is obliged to provide the Contracting Authority/end user with service quality standards in accordance with the applicable provisions of the Energy Law, in particular the Regulation of the Minister of Climate and Environment on the detailed conditions for the operation of the power system of 22 March 2023 (Journal of Laws of 2023, item 819).

5. The supply of energy will take place on the basis of agreements concluded separately by individual end users.

6. The Contracting Authority declares that the forecast of energy consumption indicated above and in the Appendix to the Terms of Reference "Detailed description of the subject of the contract" is only an approximate value, which may be increased or decreased in relation to the forecasts concerning individual Customers during the performance of the Agreement. The actual energy consumption (lower or higher than the forecast of energy consumption) will depend solely on the actual needs of individual end users, however, regardless of the amount of consumption, the Contractor is obliged to apply the energy prices offered in the tender in each case. The Contractor may not pursue any financial claims (e.g. damages) from the Contracting Authority or the End Customers if, during the term of the contract, the Contracting Authority or individual End Customers purchase from the Seller a smaller or larger amount of electricity than the forecasted amount of energy, in particular caused by an increase or decrease in the number of Energy Consumption Points (PPE) for individual Customers, a change in the tariff group, a change in the ordered capacity or parameters technical specifications of the EPP.

7. The purpose of this joint procurement is to unify rates and simplify the rules for settling active electricity consumption. The Contracting Authority intends to achieve the above in particular by obtaining a single, fixed price per kilowatt hour, appropriate for individual tariff groups, therefore the offered unit price of electricity must include all additional costs and fees related to the performance of the subject of the contract, including in particular those resulting from commercial balancing or fixed costs of trade fees. Electricity should meet technical standards in accordance with the provisions of the Energy Law and its implementing regulations and Polish Standards. In the event of failure to meet the quality standards of service, the Contracting Authority is entitled to a discount at the written request of the Contracting Authority at the rates specified in the Regulation of the Minister of Climate and Environment on the method of shaping and calculating tariffs and the method of settlements in electricity trading of 29 November 2022 (Journal of Laws of 2022, item 2505) or in any subsequent legal act specifying these rates.
