The subject of the contract is: service of implementation of the library resource management system in the cloud computing along with ensuring the continuity of the system in the SaaS model.
1. The subject of the contract is: a service for the implementation of a library resource management system in the cloud computing along with ensuring the continuity of the system in the SaaS model, hereinafter referred to as the "service".
2. The scope of the order shall include:
1) System Implementation, including:
1.1. Stage I
a) Providing access to the System, the first Data Migration from currently used library systems to the shared System,
b) configuration, introduction of settings in accordance with the OPZ and testing of the System,
c) conducting training of System users, including administrators,
d) receipt of the first configuration and setting of the System;
1.2. etap II
a) the second Data Migration from currently used library systems, testing, configuration and final introduction of System settings in accordance with OPZ,
b) final acceptance of the System;
2) providing the service of ensuring the continuity of the System's operation in the SaaS (Software as a Service) model – for a period of 36 months from the date of final acceptance of the System without defects and reservations.
3. The implementation of the System and the provision of the service to ensure the continuity of the System's operation in the SaaS model includes libraries of 4 Entities, i.e.:
1) Library of the Medical University of Gdańsk,
2) Gdańsk University of Technology Library,
3) Library of the University of Gdańsk,
4) Library of the European Solidarity Centre.

5. The Contractor shall be obliged to perform the contract on the terms and conditions described in the draft contract constituting Annex 4 to the SWZ.
6. A detailed description of the subject of the contract, including the required functionalities of the System and the required level of services provided after the System Implementation, is specified in Annex 5 to the SWZ.
7. The Ordering Party reserves the right to submit comments (reservations) regarding the correctness of the contract, including its scope and manner of performing works, at every stage of contract performance, in writing or electronically. The Contractor is obliged to take them into account within the time limit and scope set by the Contracting Entity, without the right to additional remuneration.
8. The Contractor is obliged to carry out the full material scope of this contract with due diligence, in a professional manner, in accordance with the terms of the procedure described in the SWZ and the contract, applicable law, best practices in the implementation of IT systems, in accordance with the principles of art and technical knowledge, generally accepted knowledge in this area, the Contractor's offer and arrangements with the Contracting Authority.
9. Requirements for employment by the Contractor or Subcontractor of persons on the basis of an employment relationship: Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires employment by the Contractor or Subcontractor on the basis of an employment relationship, within the meaning of the Act of 26 June 1974. Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended), persons performing activities in the field of contract performance. The Contractor's obligations in the scope of employment of persons are described in § 8 of the draft contract – Appendix 4 to the SWZ.
