1. The subject of the contract is a comprehensive supply of electricity - delivery together with distribution service - in the period from 01.04.2023. until 31.03.2024r. - up to 1 144 points of consumption (PPE) with a total estimated volume of 13 215 260 kWh, of which:

1) Premises and facilities 9 667 140 kWh

2) Road lighting 3 548 120 kWh

3. Division of the contract into lots:

• Part 1 of the order – Comprehensive supply of electricity to premises and facilities – detailed PPE list is attached as Annex 1a to the SWZ

• Part 2 of the order – Comprehensive supply of electricity for road lighting – a detailed PPE list is attached as Annex 1b to the SWZ.

Economic operators may submit tenders for one or two lots.

4. Details of electricity consumption at individual points of consumption according to Appendix. No. 1a/1b to SWZ List of collection points.

1. Comprehensive supply of electricity (including distribution service) to premises and facilities up to 658 PPE, with a total estimated volume of 9 667 140 kWh, including:

1) Deliveries in 2023 - 7 250 583 kWh

2) Deliveries in 2024 - 2 416 557 kWh

detailed PPE List is attached as Annex 1a to the SWZ

2. Annex 1a to the SWZ indicates to which customers (and to what extent) the maximum price will apply in 2023.

3. Delivery and distribution service period from 01.04.2023 to 31.03.2024, with the proviso that:

1) The condition for the commencement of comprehensive deliveries within the contractual period is the effective execution of the procedure of changing the seller

2) the contracting authority allows the commencement of deliveries (for individual PPE) at a later date, provided that the delay results from objective reasons referred to in point 1).

4. Mikroinstalacje:

In Attachment. 1a to SWZ the contracting authority indicated facilities in which it is planned to install RES installations – a source of photovoltaic panels and in relation to which customers plan to obtain the status of Prosumer:

1) ordering Piski County, recipient of the Forest School Complex in Ruciane-Nida, PPE number PL_ZEBB_2816015470_01 – planned date of launching the microinstallation 01.08.2023.

2) Contracting authority Municipality of Budry:

- PPE number PL_ZEBB_2819000253_04 - planned date of launching the microinstallation 01.06.2023

- PPE number PL_ZEBB_2819000260_07 - planned date of launching the microinstallation 01.06.2023

3) contracting authority Grajewo County, recipient of School Complex No. 2 named after the 9th Regiment of Mounted Rifles in Grajewo, PPE number PL_ZEBB_2004024344_08 – planned date of launching the microinstallation 01.04.2023

4) contracting the Municipality of Świętajno PPE number PL_ZEBB_2813000886_01 - planned date of launching the microinstallation 01.10.2023.

5. Electricity produced in a RES installation and put into the grid will be settled on a net-billing basis, i.e. surplus energy from photovoltaics will be settled according to the average RDN price from the previous calendar month, which will be published by the Energy Market Information Operator (OIRE).

6. In order to conduct settlements according to the net-billing system, the Seller will keep an account for the Renewable Energy Prosumer, on which the amount of electricity and the value of electricity and the resulting value of funds for electricity due to the prosumer for electricity introduced into the network - Prosumer Deposit will be recorded.

7. If as at 31/03/2024 unused funds remain in the Prosumer Deposit, the contractor will be obliged to transfer them to the bank account indicated in the Comprehensive Energy Sale Agreement.

8. The contracting authority is obliged to inform the contractor about any changes affecting the method of conducting settlements, in particular about the loss of the Prosumer status, changes in the total installed capacity in the micro-installation, type of energy source in the micro-installation, permanent disconnection of the micro-installation from the DSO network, within 14 days from the date of change.

9. City of Kolno

Since 2015, micro-installations have been used in the facilities listed below, for which the recipients have the status of the Producer. All electricity produced in installations is consumed for consumers' own needs – energy is not returned to the public grid:

2. All electricity consumed in 2023 will be covered by the maximum price (provided that the Declaration of the entitled customer required by the regulations is effectively submitted).

3. Delivery and distribution service period: from 01.04.2023 to 31.03.2024, provided that:
