The object of the order is to finance the purchase of public transport buses in the form of a financial lease. The subject of the lease is three used vehicles of Scania type M321 Citywide LF, year 2016, with a total net worth of 2,016,000.00 PLN (words: two million sixteen thousand zlotys 00/100), and runs of 220 368 km, 228 326 km, 217 987 km. The value of each vehicle is 672 000.00 PLN net. The supplier of vehicles was selected in the tendering procedure carried out (TED No 2021/S 078-199059). The Contracting Authority requires the conclusion of three separate contracts.

1. The object of the order is to finance the purchase of public transport buses in the form of a financial lease. The subject of the lease is three used vehicles of Scania type M321 Citywide LF, year 2016, with a total net worth of 2,016,000.00 PLN (words: two million sixteen thousand zlotys 00/100), and runs of 220 368 km, 228 326 km, 217 987 km. The Contracting Authority requires the conclusion of three separate contracts.

2. Lease data:

(a) the initial fee (installment number “0”) shall be 9,82% of the net value of the lease subject, i.e. PLN 198 000,00 (word: one hundred ninety-eight thousand PLN);

(b) the total number of installments: 47 monthly installments for each vehicle. The Contracting Authority assumes repayment in 46 capital installments at PLN 30,000 (in words: thirty thousand zlotys) per month, and the last 47 instalment will total PLN 438 000.00 (words: three hundred and thirty-eight thousand zlotys). The breakdown of capital installments for vehicles and the terms of repayment shall specify in detail the description of the subject matter of the contract (SWZ

3. The Contracting Authority stipulates that the delivery of vehicles and their receipt will take place successively.

4. Entry fees (installments “0”) will be paid by the Ordering Party within 30 days from the date of conclusion of the lease agreement, however, prior to registration and receipt of the lease. VAT will be paid together with the initial fee.

5. In addition to the fees mentioned, the Contracting Authority shall not incur any additional costs associated with the operation of the lease in the form of: bail charges, manipulation, administrative fees, for additional activities, etc.

6. The Contracting Authority reserves the possibility of making an early, partial repayment of the contract. If such repayment is made, the Contractor shall advance it on the request of the Contracting Authority for early repayment of the principal and, where necessary, adequately reducing the duration of the lease contract. After repayment, the interest installments will be re-established with the Contractor's original margin.

7. No security for the performance of the contract on the part of the Ordering Party

8. Lease installments counted separately for each vehicle, payable from the month following the month of receipt of the lease. The installment payment day fixed for each 5 day of the month.

9. After the expiry of the duration of the lease agreement and subject to receipt by the Contractor of all charges due, the Contractor shall transfer ownership of the subject of the lease to the Contracting Party.

10. The Contracting Authority provides, during the duration of the lease agreement, insurance of the subject of the lease in respect of OC, AC and NNW risks. The policies confirming the conclusion of the insurance with their payment, the Ordering Party shall provide the Contractor within 14 days of their conclusion (the first policies will be issued on the date of registration of the vehicles, for the sum of insurance in accordance with the signed contract of delivery of the vehicles.

With regulations of the Contractors based on the WIBOR rate for 1 monthly deposits (1M). For the comparability of tenders submitted, the reference rate WIBOR 1M applicable at 1 July 2021 should be taken into account for the determination of lease installments fixed in PLN and installments will change as the WIBOR 1M base rate changes.

12. Any costs associated with the conclusion of the lease agreement (including possible valuation costs for the lease items, the costs of issuing them to the Ordering Party and other details not mentioned) the Contractor shall be incurred in his own right.
