The purchase and delivery includes 26 pieces of brand new, non-operated, fully low-floor single-unit FCEV buses, MAXI class to the place indicated by the Ordering Party, with technical specifications in accordance with OPZ, adapted to transport people with disabilities along with additional equipment, software and documentation. The subject of the contract is defined by: Draft Agreement Provisions (PPU) – Annex No. 1 to the SWZ, Description of the subject of the contract (OPZ) – Annex No. 2 to the SWZ. The contractor whose offer is considered the most advantageous will be obliged to provide a performance bond. Criteria for evaluating offers: price -60%, evaluation of technical solutions -20%, evaluation of warranty conditions -20%. The contracting authority requests the submission of the evidence in question: Test report for the offered type of bus confirming the offered fuel consumption determined according to the SORT 2 test, made by an independent research or scientific unit.

The Contractor may entrust the performance of part of the contract to Subcontractors.Contractors may jointly apply for the award of the contract. In such a case, the Contractors shall appoint a representative to represent them in the procurement procedure or to represent them in the procedure and conclude a public procurement contract. The power of attorney should be attached to the offer in electronic form. In the case of Contractors jointly applying for the award of a contract, the European Single Procurement Document (ESPD) shall be submitted by each of the Economic Operators jointly applying for the contract. This statement initially confirms the fulfilment of the conditions for participation in the proceedings and the absence of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the proceedings and the absence of grounds for exclusion. The contracting authority provides for the grounds for exclusion indicated in Article 109(1)(5) and (7) of the Act. Exclusion pursuant to Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2023, item 129 with późn.zm) takes place for the duration of the circumstances specified in point 4.6. The Contractor is also excluded on the basis of Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in connection with Russia's actions destabilising the situation in Ukraine (Dz.U. L 229, 31.7.2014) as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 2022/576). L 111 of 8.4.2022). The Contractor is obliged to submit together with the offer a statement constituting a preliminary confirmation that the Contractor as at the date of submission of tenders:a) is not subject to exclusion, b) meets the conditions for participation in the procedure. In the proceedings in question, communication between the Contracting Authority and the Contractor, including the submission of tenders, exchange of information and the transfer of documents or statements, taking into account the exceptions provided for in the Act, takes place using electronic means of communication, via the Platform located at: https://umchelm.ezamawiajacy.pl in the "Correspondence" tab. General rules for using the Platform:

1) notification to the proceedings requires the Contractor to log in to the System on the subdomain Name of the Unit; https://umchelm.ezamawiajacy.pl, or https://oneplace.marketplanet.pl. 2) After selecting the "Join the proceedings" option, the Contractor will be redirected to the https://oneplace.marketplanet.pl website, where he will be notified about the possibility of logging in or creating a free account. The Contractor creates an account by following the steps of the registration process; He gives an e-mail address, sets a password, then repeats the password, enters the code from the picture, accepts the regulations, clicks the "Register" command.

3) Registration of the Contractor: Account registration takes place automatically by: - signing the application with an electronic signature (qualified, personal or trusted profile) or contacting the phone number provided in the confirmation, or - if the user does not sign the application or contact by phone - the account will be activated within a maximum of 6 business hours. Therefore, the Contracting Authority recommends Contractors to take into account the time necessary for registration in the process of submitting the Offer in electronic form. Together with the confirmation of submitting the registration application, the Contractor will receive information about the possibility of speeding up the procedure of creating an account, then please contact the telephone number provided in the above-mentioned confirmation.4) After creating an account, the Contractor has the opportunity to submit an offer in the proceedings. The date of submission of offers, documents or statements is the date of their sending via the "Correspondence" tab.
