The procedure is conducted in the open tender procedure in the design and build formula. A detailed description of the subject of the contract is attached as Annex 7 to the PFU together with the Conceptual Design. The subject of the contract is divided into the following stages: a) development of complete design documentation in the scope of the contract in question, necessary to obtain the appropriate administrative decision for the implementation of the task (building permit) along with obtaining all required arrangements, opinions, permits within 120 calendar days from the date of conclusion of the contract. Details regarding the development of documentation are included in the Functional and Utility Program together with the Conceptual Design (hereinafter referred to as PFU) constituting Annex 1 to the contract – Stage I; b) execution of all construction works together with the necessary accompanying infrastructure, land development, construction of networks and non-toothed installations for the functioning of the subject of the contract based on design documentation made by the Contractor and approved by the Contracting Authority, along with non-works services construction and all necessary preparatory works (organization and protection of the construction site) needed to perform the entrusted contract, accompanying and temporary works, delivery and assembly of equipment in accordance with the detailed guidelines contained in the PFU, connector No. 8.1 – 8.8 and the performance of all activities required by the provisions of the Act of 7 July 1994. Construction law together with the preparation of comprehensive as-built documentation and obtaining a valid occupancy permit for the Ordering Party within 18 months from the date of handing over the construction site – Stage II – this is the maximum term of the contract. If, in the criterion, the Contractor proposes a shorter deadline for the performance of the contract, it will be obliged under the contract to perform the construction works within the proposed deadline. c) removal of defects and defects of the subject of the contract and provision of maintenance services for installed systems and devices during the warranty period - Stage III. The contracting authority requires the means of proof in question, which are specified in detail in point 12(c) of the SWZ. The subjective means of evidence that will have to be submitted by the contractor whose bid was rated the highest, before awarding the contract in order to confirm the absence of grounds for exclusion and confirm the fulfillment of the conditions for participation in the procedure, are described in detail in point 13 of the SWZ.
