Stadt Rüsselsheim am Main - Award of planning services for preparatory studies for urban development in the area of Rüsselsheim West including the Stellantisflächen (formerly Opel)
The city of Rüsselsheim am Main intends to provide planning services for a preparatory investigation within the meaning of § 165 Abs. 4 BauGB in conjunction with § 141 BauGB for urban development in the area of Rüsselsheim West including the Stellantisflächen (form. Opel).
On 02.06.2022, the magistrate was commissioned by the city council to carry out preparatory investigations in accordance with § 165 Abs. 4 BauGB for the area Rüsselsheim West including the Stellantisflächen (formerly Opel). The area is located in the west of the city of Rüsselsheim am Main and covers an area of about 128 ha.
The subject of the preparatory investigation is, on the one hand, the preparation of an expert opinion in which the assessment bases on the future determination of the prerequisites pursuant to § 165 Abs. 3 BauGB are presented and evaluated. For this purpose, the future contractor must examine the formal and material application requirements for an urban development measure in accordance with § 165 BauGB. It takes over the overall coordination of the project and has to condense the existing and the knowledge to be gained in a development scenario and implementation concept and to discuss them with authorities and other bodies responsible for public interests. The subject matter of the preparatory investigations are, in particular, findings on the necessity of developing the area with reference to the requirements of § 165 sec. 2 BauGB, the general willingness of the owners to cooperate and sell, the necessity of the special development law instruments, the general objectives of development to be pursued and the assessment of the rapid feasibility of the measure in general within the meaning of § 165 BauGB.
The future contractor must also check whether the formal requirements for the implementation of an urban development measure pursuant to § 165 (2) and (3) BauGB are met and present the findings under planning law.
The result of this examination must be documented in a final report on the preparatory investigations, which meets the requirements of § 165 Abs. 4 BauGB for the assessment bases on the determination requirements for an urban development measure according to § 165 Abs. 3 BauGB. The final report serves as a basis for the decision of the city council of the city of Rüsselsheim am Main as to whether an urban development measure can and should be carried out. Against this background, the future contractor must ensure that all matters necessary for this decision are adequately addressed and documented. This includes both the planning and the economic level.
During the preparatory investigations, the participation of the public and the participation and participation of public authorities are of particular importance, cf. §§ 137 to 139 BauGB. The performance of the future contractor therefore includes, in addition to the exercise of the rights to information pursuant to § 138 BauGB, also the procurement of information from public authorities within the meaning of § 139 BauGB and the subsequent discussion of the knowledge gained with the authorities and public authorities as well as the neighbouring municipalities, as well as the evaluation of the resulting results.
