1. The subject of the order is “DESIGN AND MONTAPE OF SŁONECZO MODEL ON THE TERENCE OF WPKiW S.A. in CHORZOW”

2. Specific conditions of the Contracting Authority concerning the conduct of investments in the Park

Silesian:

1) The Contractor shall be obliged to comply with the provisions of the regulations of order in force on the territory of the WPKiW S.A. The zone of residence applies,

which obliges the Contractor's vehicles to park in designated parking lots and travel at a maximum speed of up to 20km/h as well as comply with the principle of pedestrian precedence in front of the vehicle;

2) work will be able to be carried out on weekdays from Monday to Friday

from 8:00 - 18:00, possibly after obtaining any approval of the Ordering Party

Saturdays, 6:00 - 12:00 a.m.

3. Additional conditions for execution of the contract are defined by the proposed provisions of the contract

(Annex 2 to SWZ).

4. Equivalent solutions:

1. The Functional and Utility Programme contained in Annex 3 to SWZ does not indicate trademarks, patents or origin, source or specific process that characterizes the products or services provided by a particular contractor.

In view of the above, Article 99 (5) and (6) of the Pzp Act does not apply;

2) The Functional and Utility Programme contained in Annex No 3 to the SWZ was not referred to

to the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of Law Pzp.

Consequently, Article 101 (4) of the Pzp Act does not apply.

5. Information on the measures of evidence in question:

1) to confirm that the services offered meet the requirements specified by the Contracting Authority and characteristics in the description of the object of the contract (Annex 3 to SWZ), the Contracting Authority requests to submit together with the offer of the following measures of evidence in question: photos or drawings of the proposed items, catalogues, as well as technical approvals or certificates for use in the country;

2) The Contracting Authority accepts the equivalent measures of evidence in question, if they confirm,

that the services offered meet the requirements specified by the Contracting Authority and characteristics

in Functional-Utility Programme (Annex No 3 to SWZ);

3. If the Contractor does not submit the measures of evidence in question or the measures in question are incomplete, the Contracting Authority pursuant to Article 107

paragraph 2 of the Pzp Act, will call for their submission or supplement within the prescribed time limit;

4) The Contracting Authority in accordance with Article 107 (3) of the Pzp Act will not call for the submission or supplement of the evidence in question if the offer is subject to rejection or there are indications of annulment of the proceedings;

5) The Contracting Authority, pursuant to Article 107 (4) of the Law Pzp, may request clarification from the Contractors on the content of the evidence in question.

6. Subcontracting requirements:

1. In the light of Article 462 (1) of the Pzp Act, the Contractor may entrust the execution of a part of the contract to

2. in that case, pursuant to the content of Article 462 (2) of the Pzp Act, the Contracting Authority shall request that the Contractor indicate, in the tender, the parts of the contract to which it intends to entrust the subcontractors and the names of possible subcontractors, if they are already known.

Where the modification or resignation of a subcontractor relates to an entity whose resources the Contractor relied upon, under the principles laid down in Article 118 (1) of the Pzp Act, to demonstrate that the conditions of participation in the proceedings are fulfilled, the Contractor shall demonstrate to the Contracting Authority that the proposed other the subcontractor or the Contractor shall independently satisfy them to a degree not less than the subcontractor whose resources the Contractor relied upon during the procurement procedure.
