1.The subject of the order is to conduct bank service of the budget of Mielecki County and 15 subordinate units.

2.A detailed description of the subject matter of the contract, including the relevant provisions of the contract, includes Annex No 4 to the SWZ.

3.The Contracting Authority, in accordance with Article 95 (1) of the Act, requires employment by the Contractor /subcontractor on the basis of the contract of employment of persons performing the performance of the object of the contract directly related to the maintenance and maintenance of the bank accounts of the Contracting Authority throughout the period the performance of these activities where the performance of such activities consists in the performance of work in the manner laid down in Article 22 (1) of the Act of 26 June 1974 of the Labor Code (Journal of Laws of 2020, item 1320).

4.Any documents relating to the procedure - specification of the terms of the contract (abbreviated “SWZ”) together with the annexes the Ordering Party shall post the website https://powiat-mielecki.logintrade.net/rejestracja/ustawowe.html in the details of the procedure concerned.

1. The subject of the order includes:

1.1. opening and maintaining the current account of the budget of Mielecki County;

1.2. opening and maintaining accounts of income and expenditure;

1.3. opening and maintaining other accounts in golds and convertible currencies, in particular the Social Benefits Fund's Works Account, “project” accounts, deposit sum accounts, etc.;

1.4. the provision of an electronic banking system;

1.5. operating a virtual balances consolidation service;

1.6. generation and transfer of bank statements;

1.7. support for bulk payments;

1.8. the implementation of cash deposits and withdrawals on/from the accounts of the Contracting Authority, including by means of an electronic cheque;

1.9. the implementation of domestic and foreign transfers (electronic and paper);

1.10. implementation of foreign exchange operations related to the making of foreign exchange payments, foreign exchange receipts

1.11. the operation of banking services with fees (automatic cash registers) and payment terminals;

1.12. Enabling payment by counterparties to the Contracting Authority by means of payment card terminals, including mobile payments, e.g. via mobile phone (e.g. BLIK) in fees and locations indicated by the Ordering Party;

1.13. the provision of short-term credit in the overdraft of the budget of Mielecki County;

1.14. providing a banking advisor and technical advisor dedicated to cooperating with the Contracting Authority;

1.15. Preparation of opinions, statements and reports in the field of banking service;

1.16. inform the Contracting Authority of the seizures of property rights constituting claims from bank accounts, of incorrect payments and of the failure to fulfil payments on a given day from the account.

2. The proceedings are carried out pursuant to Article 132 of the Act of 11 September 2019. Public Procurement Law (i.e., Journal of Laws 2021, item 1129 as amended, hereinafter referred to as the “Law”) by unlimited tender.

3. The Contractor may entrust execution of part of the contract to the subcontractor. The Contractor who intends to execute the contract with the participation of the subcontractor must clearly indicate the part of the contract to which the execution will be entrusted to the subcontractors and specify the names of the subcontractors together with the subject of the subcontracting contracts for which they are proposed. The Contractor shall be obliged to inform immediately of any changes concerning subcontractors that occur during the execution of the contract. Entrusting the execution of part of the contract to subcontractors shall not relieve the Contractor from the responsibility for the proper execution of the contract

4. The Contracting Authority, in accordance with Article 139 (1) of the Act, may first examine and evaluate tenders and then make the qualification of the Contractor whose offer has been highest assessed in the absence of grounds for exclusion and fulfilment of the conditions of participation in the proceedings.
