1. Revitalization of boulevards and quays, including reconstruction of fortifications, development of the riverside area of the Brda River with accompanying infrastructure.
2. For the implementation of the investment, the City of Bydgoszcz received a preliminary promise regarding co-financing from the "Government Fund Polish Governance: Strategic Investment Program" Programme, the Contracting Authority reserves the right to cancel the procurement procedure pursuant to Article 257 uPzp, i.e. if the public funds which the contracting authority intended to allocate to finance all or part of the contract are not awarded to it.
1. The investment includes the revitalization of the riverside areas of the Brda River, which includes the construction of new / renovation of existing quay fortifications (depending on their technical condition, including the protection of the area against flooding), development of the boulevard area on the left bank of the Brda River on the section from Krakowska Street to Żabia Street and St. Barbara Island along with the accompanying infrastructure. The subject of the contract will include the design and execution of construction works.
2. Equivalent solutions:
(a) all trade marks, patents or certificates of origin, source or specific process and standards, European technical assessments, approvals, technical specifications and technical reference systems indicated in the design documentation shall be accompanied by the words 'or equivalent';
b) wherever the subject of the contract has been described by indicating trademarks, patents or origin, source or specific process or standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority allows the Contractor to offer materials or solutions equivalent to those described in the documentation, provided that they do not lower the standards specified in the documentation, will have the required appropriate attestations, certificates or approvals and will ensure the performance of the contract in accordance with the expectations and requirements of the Ordering Party specified in the documentation. The indication in the technical documentation of exemplary trademarks, patents or origin, standards, European technical assessments, approvals, technical specifications and technical reference systems is intended to clarify the expectations of the Ordering Party in relation to the subject of the contract and is only a quality model of the subject of the contract.
c) if the Contractor proposes equivalent solutions (in the field of trademarks, patents or certificates of origin, source or specific process as well as standards, European technical assessments, approvals, technical specifications and technical reference systems), it is obliged to prepare and attach to the tender a list of all proposed equivalent solutions and prove that the proposed solutions meet the requirements specified in the description to an equivalent extent the subject of the contract.
d) if the Contractor does not submit in the tender documents on the use of other equivalent materials or equipment or solutions, it shall be understood that the materials and equipment proposed in the technical documentation were included in the calculation of the price of the offer and the performance of the subject of the contract; therefore, the Contractor is obliged to use the materials or equipment or solutions proposed in the technical documentation for the performance of the contract.
