The subject of the contract is the supply of active electricity to two facilities of the Ordering Party in the period from 01.01.2024 to 31.12.2024 in accordance with the provisions of the Act of 10 April 1997. Energy Law (Journal of Laws of 2022, item 1385, as amended), executive acts issued on its basis.

2) The estimated demand for electricity for the facilities of the Contracting Authority in the period from 01.01.2024 to 31.12.2024 is 2 013 789 kWh - Appendix No. 1, and the amount of electricity purchased during the term of the contract will not be less than 1 300 000 kWh.

3)The order covers two locations:

a) AQUARIUM Centrum Fit Rawa with its registered office in Rawa Mazowiecka

b) Zakład ZGO Pukinin with its registered office in Pukinin 140, Rawa Mazowiecka commune.

2) The estimated demand for electricity for the Ordering Party's facilities in the period from 01.01.2024 to 31.12.2024 is 2 013 789 kWh - Appendix No. 1, and the amount of electricity purchased during the term of the contract will not be less than 1 300 000 kWh.

3) The order covers two locations:

a) AQUARIUM Centrum Fit Rawa with its registered office in Rawa Mazowiecka

Katowicka 20. The ordering party conducts sports and recreational activities on the facility (municipal swimming pool). The ordering party has concluded a contract for the sale of electricity valid until 31-12-2023 and a distribution service agreement with PGE Dystrybucja SA for an indefinite period. The PPE metering and settlement system in the C23 tariff is adapted to the TPA principle. The estimated demand for electricity for the AQUARIUM Centrum Fit Rawa facility in the period from 01.01.2024 to 31.12.2024 is 1 398 932 kWh - Appendix No. 1.

b) Zakład ZGO Pukinin with its registered office in Pukinin 140, Rawa Mazowiecka commune. The contracting authority conducts waste management activities at the facility. The Ordering Party has concluded an agreement for the sale of electricity and the provision of distribution services with PGE Obrót SA, binding until 31-12-2023. The PPE metering and settlement system in the B23 tariff is adapted to the TPA principle; The Company at the ZGO Pukinin Plant has a photovoltaic microinstallation containing: a photovoltaic microinstallation with a capacity of 10 KWp, a solar panel with a capacity of 1.5 KW and a wind turbine with a capacity of 0.4 KW. The installation is disconnected from the DSO network and works only for internal needs of ZGO AQUARIUM Sp. z o.o. The estimated demand for electricity to the facility of the ZGO Pukinin Plant in the period from 01.01.2024 to 31.12.2024 is 614 857 kWh - Appendix No. 1.

4) The contract in question should be executed in accordance with the draft contract (Annex 7 to the SWZ) and the Description of the subject of the contract. The supplied electricity should meet the technical parameters indicated in the Act of 10 April 1997 – Energy Law (Journal of Laws of 2022, item 1385, as amended) and executive regulations issued on the basis of statutory delegation.

5) Order one contract covering two locations, with invoices issued separately for each location.

6) The demand for electricity was assumed on the basis of historical electricity consumption and may differ from the actual use of electricity, because it is not possible to determine in advance the amount of electricity that will be consumed by the Ordering Party.

7) The estimated demand for electricity is only indicative, used to compare offers and in no case constitutes an obligation on the part of the Ordering Party to purchase electricity in the given quantity. The amount of electricity consumed by the Ordering Party shall be determined

based on direct readings of the measurement and settlement system.

8) The Contractor shall not be entitled to any claim for failure to consume the estimated amount of energy by the Ordering Party.

9) The energy supplier is obliged to have a distribution agreement concluded with the Distribution System Operator (DSO) competent for the Ordering Party's facility, at the latest on the date of conclusion of the contract regarding the order in question, for a period of not less than until 31-12-2024.
