The subject of the proceedings is the delivery of a portable computer (laptop) - item 1 for the needs of the Poviat Eldership in Turku as part of a special-purpose subsidy received from the Wielkopolska Voivode for the task of providing free legal assistance in 2019. The contractor who refers to equivalent solutions described by the contracting authority is required to demonstrate that the supplies he offers meet the requirements specified by the contracting authority (Article 30 (5) of the Public Procurement Law). In all the provisions of the ToR and in its annexes, in which the contracting authority refers to standards, European technical assessments, approvals, technical specifications and technical reference systems in accordance with art. 30 paragraph 4 of the Public Procurement Law, the Employer allows solutions equivalent to those described. If in the description of the subject of the order the names of devices of specific manufacturers are given, it should be treated only as a determination of the desired standard and quality. In all such situations, the Contractor may offer equivalent products or devices with at least the same parameters. Product equivalence is understood as offering a product whose technical parameters of the materials used are at least the same as the products described in the ToR. If an equivalent solution is offered, the Contractor is required to demonstrate the equivalence of the solutions used. The Employer will consider the offers containing devices with parameters lower (worse) than those listed in this specification to be contrary to the ToR, and thus such offers will be subject to rejection. The awarding entity in the proceedings being conducted, based on the provisions of art. 24aa pzp, will first evaluate the offers and then examine whether the Contractor whose offer was chosen as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.
