1. The subject of the contract is: "Collection and management of municipal solid waste from the area of the Kowalewo Pomorskie Municipality in 2024"
2. A detailed description and scope of the subject matter of the contract is specified in the Description of the Subject of the Contract in the Specification of the Terms of Contract and the Draft Agreement - Appendix No. 10 to the Terms of Reference.
1. The Contractor is obliged to comply with the provisions of law during the performance of the contract, including to achieve the required levels.
2. The Contractor will be obliged to purchase and deliver to the owners of uninhabited properties and the owners of inhabited properties containers intended for the collection of any amount of municipal waste of appropriate strength for a given type of waste, made of plastic. The containers referred to in Section IV of the Terms of Use must be delivered by the deadline of 1 January 2024. The costs related to the purchase and arrangement of the containers are borne by the Contractor and it is not possible to charge them to the Contracting Authority. During the performance of the contract, the Contractor will be obliged to equip the property with appropriate containers in accordance with the Contracting Authority's notification, which will be delivered to the indicated properties within 5 working days from the date of notification by the Contracting Authority. This applies to the situation of a change in the number of containers on a given property, or new properties, if they appear during the execution of the order. If the containers are damaged or destroyed during the collection of waste due to the fault of the Contractor, the Contractor will be obliged to provide additional containers at its own expense during the performance of the contract. The Contracting Authority shall not be liable for lost, destroyed or otherwise damaged (e.g. arson) waste containers delivered by the Contractor.
3. As part of the bid price for the performance of the subject of the contract, the Contractor will be obliged to collect and manage each amount of the following municipal waste from property owners:
1) non-segregated (mixed) municipal waste;
(2) separately collected municipal waste 'at source' (paper, metal, plastics, glass and multi-material packaging, biodegradable municipal waste and ash);
(3) waste from cemeteries with codes 200201, 200202, 200203
4. The contractor will be obliged to weigh the collected municipal waste on a legalized scale.
5. The Contractor will be obliged to deliver the waste at its own expense to the installation intended for replacement service in the event of a regional failure of the installation.
6. The contractor will be obliged to monitor the obligation of the property owner to collect municipal waste separately.
7. As part of the performance of the subject of the contract, the Contractor will not be allowed to mix selectively collected municipal waste with non-segregated (mixed) municipal waste.
8. As part of the contract, the contractor will be obliged to develop a waste collection schedule for 2024 and to distribute it to property owners and other documents related to the waste management system, unless they require confirmation of receipt. The Contractor will provide the residents with the removal schedule by the following deadline by January 1, 2024.
9. The Contractor shall be liable for any damage to the property of the Contracting Authority or third parties during the collection of waste.
10. The Contractor will be obliged to collect waste lying next to garbage cans and containers, if it is the result of their actions.
11. The Contractor will be obliged to provide the service also in the event that access to the property is difficult, in particular in the case of bad weather conditions, poor condition of the road surface, repairs, detours, etc.
12. The Contractor will be obliged to perform the subject matter of the contract manually by boring containers for vehicles or, for example, with vehicles of small dimensions enabling the collection of waste from properties to which access is difficult due to e.g. narrow entrances, low gates, etc.
13. The Contractor is obliged to keep documentation related to the performance of the contract referred to in Section IV of the Terms of Reference.
