Supply of stationary containers (geometrically similar to bells) that can be lifted from above and emptied from the bottom, of different capacities and depths, equipped with alignment devices, accompanied by an integrated computer system used for the detection of contributions by citizens, with the supply on request of a special card reader, as well as the provision of technical assistance services, operational support and maintenance of containers, integrated computer system, HW / SW systems for activation / association of cards / access devices including the fees for using the installed software systems. The contractor will also be required to provide after-sales technical assistance.
The estimated quantities of containers to be supplied reported in the Technical Performance Specifications are those provided for at the feasibility design level, so that they are neither binding for the contracting authority, nor necessarily exhaustive of the supplies, which could vary in decrease or even increase, depending on the precise definition of the users affected by the supplies themselves that will be defined in the final design phase. All within the limit of the amount placed at the base of the auction, to be considered in all respects as the maximum spending limit of the negotiation relationship, except as provided for in Article 106 of the Code.
It follows that the framework agreement is not for the Contracting Authority any source of obligation to assign to the Contractor the individual supplies or services in general, much less for a predefined minimum quantity, the Contracting Authority also being free to entrust the services to other economic operators according to supervening needs deriving from the management of the public service, so that the Contractor is not entitled to awards or compensation in case of Orders lower than estimated. The Contractor, on the other hand, is obliged to perform the supplies and other services that the Contracting Authority orders on the basis of the framework agreement.
