The subject of the contract is the provision of a planned and emergency substitute bus transport service, by providing the Ordering Party with buses with drivers in the area of running trains operated by "Koleje Małopolskie" Sp. z o.o. The Contracting Authority commissions and the Contractor accepts for implementation the execution of planned substitute bus transport services including regular transport provided on routes described in detail in the Description of the subject of the contract.

The Contractor will provide ZKA in the following relations divided into two parts. For each of the lots, a separate rate per increase must be provided. The requirements presented in the Description of the subject of the contract apply to both parts. The relations on which ZKA will be provided are:

1. Krakow Main - Zastów

2. Trzebinia - Chrzanów - Libiąż - Oświęcim,

3. Brzesko Okocim - Bogumiłowice,

4. Tarnów – Nowy Sącz

5. Jasło – Nowy Sącz,

6. Tarnów – Jasło.

Minimum volume of transport work during the term of the contract: For Part I: 25 151.70 wzkm, for Part II: 18 842.64 wzkm. Maximum volume of transport work during the term of the contract: For Part I: 54 495.35 wzkm, for Part II: 40 825.72 wzkm. The planned number of ordered vehicle-kilometers is specified in Annex 2 to the Draft provisions of the agreement. The service consists in transporting passengers according to the timetable, excluding the sale of tickets. The sale and control of tickets is the responsibility of the Ordering Party's employees. The transport service will be provided in accordance with the presented bus timetable. The contractor shall dispose of the appropriate required number of buses in accordance with the presented timetable and circulation plan. The Contractor undertakes to perform the transport service in accordance with the applicable Regulations for the carriage of persons, goods and animals as well as the service and check-in of passengers "Koleje Małopolskie" sp. z o.o. (RPO-KMŁ), made available on the Ordering Party's website. The Contracting Authority shall make the Regulations available at each request of the Contractor. The tasks of the Contractor include in particular:

1. the performance of the carriage service as part of replacement bus communication;

2. providing direction (relational) boards in a format not less than A3, placed behind the windscreen and programming electronic boards. Models of markings and plates should be agreed with the Ordering Party. Examples of patterns of directional tables and conditions for their implementation will be presented by the Ordering Party;

3. choosing the route between individual stops in an optimal way due to the distance, condition of the road infrastructure, estimated travel time and road conditions, as well as obtaining from road managers all required permits for passage. In order to clarify doubts, the Parties agree that the number of vehicle-kilometers constituting the basis for calculating the Contractor's remuneration will not include additional vehicle-kilometers resulting from extraordinary cases, such as road accidents, disasters, congestion, etc.;

4. providing at his own expense a dispatcher who will be in constant contact with his drivers and the dispatcher and persons responsible for the performance of the Agreement on the part of the Ordering Party;

5. providing parking spaces and parking spaces for the Contractor's vehicles and agreeing on the use of communication stops and stations along the route. The Contractor is obliged to cover all possible costs on its own;

6. each vehicle performing the transport task must be equipped with a dedicated, permanently switched on, active mobile device with the Android operating system along with Internet access. The device must enable the installation of the application WhenThe Bus arrives, to which the Contractor agrees.

The contractor will provide 3 types of vehicles with a technical condition that meets the conditions for admission to road traffic in accordance with generally applicable regulations. Transport services must be performed by persons who meet the requirements set out in the provisions of the Act of 6 September 2001 on road transport (Journal of Laws of 2022, item 2201), the provisions of the Act of 20 June 1997. Road Traffic Law (Journal of Laws of 2022, item 988, as amended), the Act of 5 January 2011 on vehicle drivers (Journal of Laws of 2021, item 1212, as amended) and other regulations specifying requirements for drivers.
