The subject of the contract is the successive collection and management service of waste code 19 12 12 - other waste (including mixed substances and objects) from mechanical waste treatment other than those listed in 19 12 11 (large-sized waste in fragmented form). Waste from the grinding process using the DOPPSTADT DW 3060 free-speed grinder and waste code ex 19 12 12 - other waste (including mixed substances and objects) from mechanical waste treatment other than those listed in 19 12 11 (bulky waste) resulting from manual dismantling.
A detailed description of the subject of the contract is described in Annex 2 to the SWZ, i.e. description of the Subject of the contract.
The subject of the contract is the service of successive collection and management of waste with code 19 12 12 - other waste (including mixed substances and objects) from the mechanical treatment of waste other than those listed in 19 12 11 (bulky waste in crushed form). Waste resulting from the shredding process using the DOPPSTADT DW 3060 low-speed shredder and waste code ex 19 12 12 - other waste (including mixed substances and objects) from the mechanical treatment of waste other than those mentioned in 19 12 11 (bulky waste) resulting from manual dismantling. The amount of waste that will be transferred to the Contractor during the term of the contract) will amount to a maximum of 3,000 Mg.
The Contractor shall use waste in accordance with the applicable laws and recovery processes listed in Annex 1 to the Act of 14 December 2012 on Waste.
Transport of waste on the Contractor's side, at his expense, also in terms of carriage costs, insurance for the duration of transport and unloading.
Loading will be carried out with the equipment of the Ordering Party - a charger. The Contractor shall carry out the collection of waste by means of transport enabling loading with equipment of the Contracting Authority.
Implementation of the service on working days during the working hours of the plant.
The total amount of waste to be managed during the term of the contract given by the Ordering Party may be reduced by a maximum of 20%.
Where the quantity of waste delivered during the period of the contract shall be less than the quantity set out in the description, the Contracting Authority has the right to withdraw from further supply of waste without any financial consequences and compensation to the Contractor.
It is recommended that the Contractor shall make a visual inspection of the waste subject to the order on the premises of the Ordering Party's installation on working days from 7:00-15:00 after the prior appointment of the deadline with the Contracting Authority.
Waste weighing will take place on the legalised weight of the Ordering Party and will be preceded by each time the generation of a waste transfer card in the electronic BDO system. The Contractor will confirm in the electronic BDO system the amount of waste received each time for the management of the code 19 12 12 and ex 19 12 12.
The Ordering Party will be obliged to draw up an electronic waste transfer card in the BDO system in accordance with the Act of 14 December 2012 on waste (Journal of Laws of 2022, item 699, as amended) and the Contractor will be obliged to confirm it at the time of taking over the waste. In the absence or erroneously confirmed by the Contractor of the Waste Transfer Card or the lack of other required documents, the Ordering Party has the right to refuse to pay the VAT invoice until the relevant documents are provided. Information about the refusal to pay will be provided to the Contractor vice versa, via fax.
The Contractor shall accept waste from the Contracting Authority in a succession manner consistent with the needs of the Contracting Authority.
The Contractor shall collect waste from the Ordering Party within 48 hours from the moment of submitting the notification by the Ordering Party.
At the time of transfer of the waste by the Contractor to the Contractor, the Contractor shall assume responsibility for the seized waste and due handling thereof and the consequences resulting from it.
The Contractor is obliged to provide the Ordering Party with written information on the method of waste management after the end of each half-year in accordance with the Act of 14 December 2012 on waste (Journal of Laws of 2022, item 699, as amended) in which the waste collection will take place, within 14 days from the end of each half-year. The place for waste management must meet the requirements set out in the Act of 14 December 2012 on waste (Journal of Laws of 2022, item 699, as amended).
