Description:
“Delivery with partial installation of lighting poles”

1. Purchase and supply of 200 factory-new aluminum lighting poles together with dedicated foundations in the amount of 167 pieces, lighting fixtures and light sources in the amount of 200 pieces and installation of 33 pieces of supplied lanterns in place mounted by the Ordering Party .

2. Date of execution of the order for:

(a) delivery — 40 days from the date of signing the contract, confirmed by the partial receipt protocol,

(b) assembly — up to 365 days from the date of signing the contract, on the basis of separate orders of the Contracting Authority, the assembly date for each order shall not exceed 45 days from the date of its receipt, confirmed by the protocols of partial receipts.

3. The timely execution of the order shall be considered to carry out the entire delivery confirmed by the protocol of receipt of the object of the contract, the provision of the documents indicated in § 1 (7) of the contract and the installation of the

1. The item of the order is “Delivery with partial installation of lighting poles”.

2. This order:

1) forms part of Task No 14 — 'Arrangement of public spaces (park furniture, small architecture elements, public toilets) ';

2) will be implemented in the framework of the agreement for the financing of the Municipal Project “Modernization of the Silesian Park” carried out in the second trading of funds returning from the JESSICA Regional Operational Programme of the Silesian Voivodeship for the period 2007-2013;

3) includes:

— delivery of 200 lighting poles and their landing in order to be laid down in a place indicated by the Contracting Authority in the territory administered by the Contracting Authority,

— installation of 33 of the supplied lighting poles in the place indicated by the Contracting Authority in the territory administered by the Ordering Party. The Contractor shall proceed to assemble individual poles within the dates indicated in the contract and the procurement documents.

3. A detailed description of the subject matter of the order, hereinafter referred to as OPZ, contains Annex No 3 to SWZ.

4. Special conditions of the Ordering Party concerning the conduct of investments in the Silesian Park:

1) The Contractor will be obliged to comply with the provisions of the regulations applicable in the territory of the WPKiW S.A. A zone of residence is valid on the territory, which obliges Contractor's vehicles to park in designated parking lots and to move at a maximum speed of up to 20km/h as also adherence to the principle of pedestrian precedence before vehicle;

2) the work will be able to be carried out on weekdays from Monday to Friday from 8:00 - 18:00, possibly after obtaining any consent of the Ordering Party on Saturdays from 6:00 - 12:00.

5. Additional conditions for the execution of the contract are defined by the proposed provisions of the contract (Annex 2 to SWZ).

6. Equivalent solutions:

1. The description of the object of the contract in Annex 3 to SWZ does not indicate trademarks, patents or origin, source or specific process that characterizes the products or services provided by a particular contractor.

In view of the above, Article 99 (5) and (6) of the Pzp Act does not apply;

2. the description of the object of the contract in Annex No 3 to SWZ does not refer to the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of Law Pzp.

Consequently, Article 101 (4) of the Pzp Act does not apply.

7. Information on the measures of evidence in question:

1) to confirm that the deliveries offered meet the requirements specified by the Contracting Authority and characteristics in the description of the object of the contract (Annex 3 to SWZ), the Contracting Authority requests to submit together with the offer of the following measures of evidence in question: photos or drawings of the proposed items, catalogues, as well as technical approvals or certificates for use in the country;

2) The Contracting Authority accepts the equivalent measures of evidence in question if they confirm that the deliveries offered meet the requirements laid down by the Contracting Authority and the characteristics in the description of the object of the contract (Annex 3 to SWZ);

3. If the Contractor does not submit the measures of evidence in question or the measures of evidence submitted are incomplete, the Contracting Authority pursuant to Article 107 (2) of the Pzp Act, shall call for their submission or supplement within the time limit set;

4) The Contracting Authority pursuant to Article 107 (3) of the Pzp Act will not call for the submission or supplement of the evidence in question if the offer is subject to rejection or there are indications of annulment of the proceedings.

5) The Contracting Authority, pursuant to Article 107 (4) of the Law Pzp, may request clarification from the Contractors on the content of the evidence in question.

8. Subcontracting requirements:

In the light of Article 462 (1) of the Pzp Act, the Contractor may entrust the execution of a part of the contract
