2. The offer must cover the entire contract, the Contracting Authority does not allow partial bids to be submitted.

Justification for not dividing the contract into lots:

The subject of the contract, i.e. delivery and assembly of the queuing system, has not been divided into parts due to the specificity of the subject of delivery and is justified by technical reasons, including the need to maintain hardware and software compatibility. Dividing the contract into lots would cause disproportionate difficulties

coordination and organisation of activities of different economic operators implementing individual lots, which could seriously jeopardise the proper performance of the entire contract. The scope and specificity of the contract justify the award of the contract to a single economic operator, which will assume the systematic performance of the whole task and responsibility for the proper cooperation of hardware and software. Dividing the contract into smaller lots may result in dilution of liability for possible deficiencies in the indicated scope, untimely implementation of individual lots (lack of tenders, lengthy procedures for individual lots)

and the transfer of these risks to the Contracting Authority, which in consequence may be an obstacle to the effective spending of funds and timely execution of the entire contract. The contracting authority described the order in a way that allows the execution of the order also by small

and medium-sized enterprises, it also did not limit the participation of subcontractors.

In view of the above, it must be concluded that the absence of division of the contract into lots does not restrict competition and ensures equal access for operators from the sector of small and medium-sized enterprises.

In addition, the subject of the contract was included in the plan of proceedings for 2023 and is part of the contract under item 2.2.8 Multimedia devices (audiovisual, projectors, television and audiovisual equipment, multimedia boards) with a value of PLN 600,000.00. It must therefore be held that the supply of the queuing system is divided into lots and that the present proceedings form a single whole.

3. The subject of the contract should be implemented on the basis of the assumptions set out in the Assortment and Price Specification constituting Annex 2 to the SWZ and in the Technical Specification constituting Annex 3 to the SWZ.
