As part of the contract entitled: "Construction of water and sewage infrastructure, installation of photovoltaic panels and purchase of a rescue and firefighting vehicle in the Łękawica Commune", the Contractor will be obliged to deliver and install photovoltaic installations on public utility buildings in the Łękawica Municipality, meeting the parameters described in Appendix No. 8 to the Terms of Reference – Description of the subject of the contract.
1. As part of the contract entitled: "Construction of water and sewage infrastructure, installation of photovoltaic panels and purchase of a rescue and firefighting vehicle in the Łękawica Commune", the Contractor will be obliged to deliver and install photovoltaic installations on public utility buildings in the Łękawica Municipality, meeting the parameters described in Appendix No. 8 to the Terms of Reference – Description of the subject of the contract.
2. Equivalence clause:
1) The Contracting Authority, in accordance with the provisions of Article 99(5) and Article 101(4) of the Public Procurement Law, allows equivalent solutions for construction works, supplies, works, materials, systems that meet the requirements specified in the procurement documents. The Contracting Authority stipulates that wherever the content of the Terms of Reference or Appendix No. 8 to the Terms of Reference – Description of the subject matter of the contract, constituting a description of the subject matter of the contract, indicates trademarks, patents or the origin of equipment or materials in the description of this subject matter, they should be treated only as proposals. The Contracting Authority accepts methods, materials, devices, systems, technologies, etc. equivalent to those presented in the description of the subject-matter of the contract. Therefore, it is permissible to offer any equivalent market equivalents with properties not worse than those indicated by the Contracting Authority. The parameters indicated in the procurement documents specify the minimum technical, operational, functional, quality and functional conditions to be met by the subject of the contract. The offer includes methods, materials, devices, systems, technologies, but with technical and quality parameters, as well as functional and functional properties. At the request of the Contracting Authority, the Contractor is obliged to prove that the applied solutions will allow to achieve all technical assumptions for the investment task in question, taking into account the entire investment, and not a selected fragment of the whole. The burden of proving that the material or equipment is equivalent to the requirement specified by the Contracting Authority rests with the Contractor. If the materials and/or equipment offered by the Contractor as equivalent are not equivalent in the light of the documents submitted by the Contractor, the offer of the Contractor shall be rejected as not conforming to the terms of reference. In the case of describing the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority allows the performance of the contract with the use of solutions equivalent to those described. In such a case, the procedure described in the earlier text of this section shall apply mutatis mutandis;
2) in the case of technologies, systems, materials or equivalent devices accepted by the Contractor for valuation, the offer must be accompanied by a list of these technologies, systems, devices or materials, which will include in its content a statement of: the type and description of the technology or system used, the name of the device/ material used, the name of the manufacturer, the precise and unambiguous type of device or material;
3) in addition, for technologies/systems/devices/equivalent materials, the Ordering Party requires proof of equivalence, m.in by means of technologies/systems/devices/equivalent materials attached to the list; calculations, detailed technical drawings, attestations, approvals, declarations of conformity with regulations and standards and data sheets of manufacturers of equipment/equivalent materials. These documents must clearly state the equivalence of the proposed technologies/systems/equipment/materials;
