The subject of the contract (basic, guaranteed) is the lease to the Ordering Party of multifunctional devices color A3 and A4 along with service for a period of 48 months. The subject of the contract also includes training of 25 employees of the Ordering Party in the operation of the delivered devices.
1. The subject of the contract (basic, guaranteed) is the lease to the Ordering Party of multifunctional devices color A3 and A4 along with service for a period of 48 months. The subject of the contract also includes training of 25 employees of the Ordering Party in the operation of the delivered devices.
By service service, the Ordering Party understands, among other things, all necessary work related to the maintenance of devices in constant availability (in particular all consumables, inspections, maintenance, naturally wearing materials, and not consumables). The service includes the delivery of all consumables (in particular, it includes, m.in free repairs, inspections, replacement of all components, worn or broken parts, free delivery of toners and waste toner tanks, replacement of all other consumables). Paper delivery is not included in the service.
A detailed description of the subject of the contract (OPZ) is attached as Annex 9 to the SWZ.
The subject of the order must come from a legitimate source and be intended for use in Poland.
2. The Contracting Authority shall not provide for an electronic auction.
3. The Contracting Authority shall not conduct proceedings for the conclusion of the framework agreement.
4. The Contracting Authority shall not allow for the possibility of submitting a bid providing for a manner of performance of the contract other than that specified by the Contracting Entity.
5.The Contracting Party shall not allow submission of partial tenders.
6. The Awarding Entity does not allow submitting variants.
7. The contracting authority does not provide for the possibility of awarding contracts referred to in Article 214(1)(8) of the Public Procurement Law.
8. The Contracting Authority does not require that persons participating in the performance of the contract be employed by the Contractor or Subcontractor on the basis of an employment contract within the meaning of the provisions of the Act of 26 June 1976 – Labour Code (Article 95 of the Public Procurement Law).
9. The Contracting Authority does not provide for requirements for the employment by the Contractor of persons referred to in Article 96(2)(2) of the Public Procurement Law.
10. The Contracting Authority shall not reserve the right to apply for the award of a contract only by the Contractors referred to in Article 94 of the Public Procurement Law.
