Description:
Delivery of an integrated and automated system for measuring physical properties at low temperatures and in a magnetic field for the Faculty of Physics and Astronomy

The subject of the contract is the delivery of an integrated and automated system for measuring physical properties at low temperatures and in a magnetic field for the Faculty of Physics and Astronomy, together with the installation, commissioning and training of employees in the field of operation.

1. Type of order: delivery.

2. The subject of the contract is the delivery of an integrated and automated system for measuring physical properties at low temperatures and in a magnetic field for the Faculty of Physics and Astronomy, together with the installation, commissioning and training of employees in the field of operation.

3. The delivery includes, m.in the costs of transport, delivery, insurance, bringing to the place indicated by the Ordering Party, setting up the equipment, installation, connection to the network, commissioning of the subject of the contract, calibration and execution of trial tests.

4. A detailed description of the subject matter of the contract along with the minimum requirements of the Contracting Authority is included in Appendix No. 3 to the Terms of Reference – Description of the subject of the contract (specification and technical parameters). The Contractor is obliged to fill in (along with the name, manufacturer, model, type or other features necessary to unambiguously identify it; this also applies to offering equivalent solutions), sign and attach to the offer Appendix No. 3 to the Terms of Reference, which allows to confirm the compliance of the offered equipment with the requirements of the Contracting Authority, taking into account any Information for Contractors.

5. The detailed scope of obligations to perform the subject matter of the contract, the terms of the guarantee and the terms of payment are indicated in the Model Agreement constituting Appendix No. 4 to the Terms of Reference.

6. The Contracting Authority requires the Contractor to conduct training in the use of the measurement system after its acceptance and installation (Appendix No. 3 to the contract - Quantitative Acceptance Protocol and Appendix No. 4 to the contract - Qualitative Acceptance Protocol).

6.1 Within the time agreed with the Contracting Authority, the Contractor shall prepare and conduct a 3-day training at the Contracting Authority's premises for max. 5 persons indicated by the Ordering Party.

6.2 The exact number of people taking part in the training will be communicated to the Contractor within 5 working days before the planned start date of the training.

6.3 Upon completion of the training, a training acceptance report will be drawn up (Appendix 5 to the agreement).

6.4 After the training, the Contractor shall issue personal certificates confirming the completion of the training to the persons taking part in it.

7. Place of delivery: Faculty of Physics and Astronomy, University of Wrocław, Department of Nuclear Physics and Dielectrics, pl. M. Borna 9, 50-204 Wrocław.

8. Warranty & Guarantee:

8.1 The Contracting Authority requires the Contractor to award at least one contract for the entire subject matter of the contract. 12-month warranty period (tender evaluation criterion).

8.2 The warranty period begins on the date of commencement of the warranty period and ends on the date of expiry of the quality guarantee provided by the Contractor.

8.3 The warranty period shall be counted from the date of signing the quality acceptance protocol by the Parties.

8.4 The Contractor is liable under the warranty for a period of 24 months.

8.5 The period of the Contractor's liability under the warranty begins on the date of commencement of the warranty period and ends no earlier than on the date of expiry of the quality guarantee granted by the Contractor.

9. The Ordering Party requires post-warranty service, the so-called preventive maintenance, which allows the system to be maintained in full efficiency after 2-3 years of operation.

10. The subject of the contract must be new (not regenerated, not repaired, not manufactured, not used in previous implementations), complete (in particular with all subassemblies, parts, materials necessary for commissioning and use), free from physical and legal defects, cannot be subject to the rights of third parties. The delivered subject of the order must meet all applicable legal standards, safety regulations of Poland and the European Union, have all the approvals and approvals required by law.

11. The performance of the contract is to be carried out with due diligence and in accordance with all the requirements contained in the Terms of Reference, with appendices and any Information for Contractors.
