1. The subject of the contract is construction in the "design and build" system of an automatic car wash with the necessary equipment and accompanying infrastructure at a railway siding in Wroclaw.

Building address: Wrocław Główny railway siding, ul. Paczkowska 26 (plot no. 4/137, southern region).

2. The procurement procedure is conducted on the basis of the Public Procurement Law Act (Journal of Laws of 2019, item 1843, as amended) - hereinafter referred to as the "PPL Act".

1. The subject of the contract is construction in the design and build system of an automatic car wash together with the necessary equipment and accompanying infrastructure at a railway siding in Wrocław. Building address: Wrocław Główny railway siding, ul. Paczkowska 26 (plot no. 4/137, southern region).

2. As part of the subject of the contract, referred to in para. 1 The contractor will perform:

1) documentation and project studies (hereinafter collectively referred to as "Documentation"):

a. inventory of the area and greenery,

b. construction projects broken down into necessary industries,

c. detailed designs broken down into necessary industries,

d. technical specifications for the performance and acceptance of construction works,

e. investor's cost estimate for information purposes,

f. comprehensive geodetic documentation with necessary arrangements and as-built arrangements, including mapping of land records on maps,

g. visualization of the designed object for the purposes of project promotion, in accordance with the Employer's guidelines contained in Annex 2 to the Agreement,

h. documentation and instructions necessary for the operation and ongoing maintenance of the car wash, including instructions for using the installation and equipment as well as a set of training materials,

i. confirmation of the electricity consumption of the main technological equipment of the car wash, declared in accordance with the Terms of Reference, in the washing process, in reference conditions, in the form of a calculation based on the technical and operational documentation.

2) studies, activities, works and construction works:

a. agree with the Employer and will regularly update the material and financial schedule, hereinafter referred to as the "Schedule" for the entire investment task,

b. apply to the competent authority for obtaining valid and valid:

i. the decision to determine the location of public purpose investment,

ii. arrangements for technical connection to the PKP OGN media,

iii. technical conditions of connection to the water supply and sewage system,

iv. conditions for connection to the power grid of PKP Energetyka SA after prior analysis of a possible change in conditions,

b. obtain additional required opinions, arrangements, conditions, maps for design purposes, administrative decisions necessary to implement the subject of the contract,

c. obtain agreement on the Regulations for power disconnection from the PKP Energetyka network, if necessary,

d. obtains a building permit or submits construction works not requiring a building permit,

e. perform demolition works,

f. remove any collisions with infrastructure on the investment site,

g. perform construction works based on the project documentation it has developed, in all required industries,

h. will deliver and assemble machines and devices necessary for the implementation of the investment task,

i. make plans for start-ups and tests of delivered installations and devices,

j. carry out start-ups, tests, functional tests, including confirming the declared electricity consumption of the main technological equipment of a car wash, in the washing process, under reference conditions,

k. conduct training of the Employer's staff (no more than 8 Employer's employees),

l. transfer the copyright to the documentation in the fields of exploitation specified in the contract,

m. will perform author's supervision during the implementation of the works until obtaining permission to use the object on behalf of the Employer, pursuant to art. 20 clause 1 point 4 of the Construction Law,

n. obtain permission to use the Subject of the contract.

o. perform warranty services for a period of 3 years.
