The subject of the contract is the Supply (sale) of electricity for the purposes of street lighting and traffic lights in the city and municipality of Wieliczka in 2023. Supply (sale) of electricity includes active electricity: round-the-clock, night and day. Technical parameters:

The contracting authority plans to purchase a total of approximately 4,705,000 kWh in 2023, of which the tariff includes:
active daily energy C12b - 2 016 000 kWh,
active night energy C12b - 2 619 000 kWh,
C11 energy - 70 000 kWh,
Number of collection points: 288 pcs. The collection points are located in the area of OSD-TAURON Dystrybucja Spółka Akcyjna 31-538 Kraków, 11 Jasnogórska Street. The control of road lighting is carried out by means of dusk sensors and astronomical clocks.
The Contractor who wins the tender undertakes to submit, on behalf of the contracting authority, to the Distribution System Operator competent for the Contracting Entity, a notification on the conclusion of a contract for the sale of electricity. The currently applicable distribution agreements are concluded for a definite period, i.e. until 31.12.2022. The Contracting Authority shall grant an appropriate power of attorney to the Contractor in order to conclude contracts for the provision of distribution services in a time enabling effective implementation of the procedure of changing the seller.

The Ordering Party informs that separate contracts for the sale and distribution of electricity are currently in force. They are concluded for a period of one year and their validity expires on 31.12.2022. The current electricity seller is: PGE Obrót S.A. 35-959 Rzeszów, 8-go Marca 6, the agreement is valid until 31.12.2022.
Remark. The contracting authority belongs to the group of eligible customers referred to in Article 2(2)(d) of the Act of 27 October 2022 on extraordinary measures aimed at limiting electricity prices and supporting certain customers in 2023 (Journal of Laws of 2022, item 2243). Therefore, the provisions of the above-mentioned Act apply to this order, including the price offered for the supply of electricity may not exceed the maximum price specified in Article 2(1)(b) of the aforementioned Act, i.e. the price of PLN 785 / MWh (PLN 0.785 / kWh). The Contracting Authority shall submit to the Contractor an appropriate statement referred to in Article 5 of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and support for certain customers in 2023.
Electricity will be supplied under the conditions specified in the Act of 10 April 1997 - Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended), executive regulations to this Act, and in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (i.e. Journal of Laws of 2007 No. 93, item 623, as amended), Tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), Distribution Network Operation and Operation Manual (IriESD) and generally applicable legal regulations. The Contractor is obliged to sell electricity in compliance with applicable quality standards, i.e. to provide the Contracting Authority with quality standards of service in accordance with the applicable provisions of the Energy Law.
