1. The object of the order is to develop the technical documentation, followed by the delivery, assembly and commissioning of the new factory:
1) 48 sets of photovoltaic installations with a power of 3 kWp each.
2) 92 sets of photovoltaic installations with a power of 5 kWp each.
2. The order includes 139 properties with a usable area of the building up to 300m2 and 1 property with a usable area of more than 300 m2. A detailed list of the property is contained in Annex No 9 to SWZ — Functional-Use Program.
3. A detailed description of the item of the order is included in Annex 9 to SWZ — Functional-Use Program and in Annex 10 to SWZ — Description of the item of the order.

2) 92 sets of photovoltaic installations with a power of 5 kWp each.
2. The order includes 139 properties with a usable area of the building up to 300m2 and 1 property with a usable area of more than 300 m2. A detailed list of the property is contained in Annex No 9 to SWZ — Functional-Use Program.
3. A detailed description of the item of the order is included in Annex 9 to SWZ — Functional-Use Program and in Annex 10 to SWZ — Description of the item of the order.
4. Photovoltaic installations will produce electricity for the user's own needs.
5. The subject of the contract includes, in addition to the scope described in the Functional — Utility Programme, Annex No 9 to SWZ, also the preparation of the necessary post-construction documentation and the preparation and transfer to the local power plant applications for the installation of two-way electricity meters.
6. The subject of the order covers its scope the development of technical documentation, the delivery at its own expense and the risk of complete sets of photovoltaic installations, their installation at the site indicated by the user with the launch of the installed devices, verifying their correct operation and giving them the proper configuration and training each user.
7. All materials, products and equipment under contract must be factory new, unused, free of factory and legal defects, having relevant certificates, certificates, quality certificates, must be authorised for widespread use in construction, CE marked or construction mark, or included in the list of products of little importance for health and safety in accordance with the Construction Products Act.
9. The Contracting Authority informs that where the SWZ describes the subject of the contract by indicating trademarks, patents or origin, source or specific process that characterizes the products or services provided by a particular contractor, the Contracting Authority shall allow solutions equivalent to described in the description of the object of the contract provided that they meet the criteria used in the description of the subject of the contract to assess equivalence. Where the Contracting Authority described the subject of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and (3) of Pzp, the Contracting Authority shall allow solutions equivalent to those described and shall be accompanied with respect to such words “or equivalent”.
10. The Contracting Authority indicates that the obligation to notify in the offer equivalent solutions to those described in the description of the subject of the contract and to demonstrate equivalence is on the contractor's side.
11. Where the requirements in the description of the subject of the contract relate to a trade mark, patent or origin, source or specific process that characterizes specific products or services, the Contracting Party requires that the contractor, if equivalent solutions are offered, provide already in his offer proof of equivalence proving compliance with the criteria that the Contracting Authority applies for the purpose of assessing equivalence (CTSEU judgment C-14/17 of 2018-07-12) e.g. product catalogue cards. Where the requirements in the description of the object of the contract relate to the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and (3) of the Pzp, the Contracting Authority shall require that the Contractor already provide evidence of equivalence in the the way referred to in Article 101 (5) and (6) of Pzp
12. The Contracting Authority shall request that the contractor who proposed equivalent arrangements referred to in Article 101 (4) Pzp provide evidence of equivalence referred to in Article 101 (5) and (6) of the Pzp.
