On July 8, 2020, the AGREEMENT BETWEEN THE CABILDO INSULAR DE TENERIFE, THE CONSEJO INSULAR DE AGUAS DE TENERIFE AND THE SOCIEDAD MERCANTIL ESTATAL AGUAS DE LAS CUENCAS DE ESPAÑA, S.A. for the execution and exploitation of "sanitation and purification actions on the island of tenerife" was signed. Among the Obligations of the CIATF that will derive from the aforementioned Agreement, included in its clause II (OBLIGATIONS OF THE PARTIES FOR THE EXECUTION OF THE ACTION), includes the exploitation of the actions once executed, in the terms included in clause V (EXPLOITATION OF THE WORK), where it is determined that:... once each of the works object of this Agreement has been completed and the period of testing and operation and commissioning has concluded, it will authorize the CIATF to carry out the management of the exploitation of the same, consisting of the performance of the material tasks of operation, conservation and maintenance of the infrastructure. The CIATF will be obliged to comply with the provisions in force regarding water and environmental protection... In relation to the latter, it should be borne in mind that the operation of some of the Systems included in the signed Agreement involves discharges from land to sea, which must be subject to surveillance and control in compliance with the provisions of Law 22/1988, of July 28, on Coasts and the Ministerial Order of July 13, 1993, approving the Instruction for the project of pipelines of discharges from land to sea. Specifically, of the actions currently promoted within the framework of the aforementioned Agreement, those from the Sanitation and Purification Systems (CIATF-ACUAES Systems) called:* Arona East – San Miguel * Granadilla* West The Specification of Particular Technical Prescriptions establishes the conditions on the basis of which the Surveillance and Control Programs of the different facilities object of the contract must be carried out, determining the parameters to be controlled, their frequency, planned sampling points, etc. In relation to all of the above, it should be noted that, although in the CIATF there is currently a service contract in force for the REALIZATION OF THE SURVEILLANCE AND CONTROL PROGRAMS OF THE INFRASTRUCTURES WITH AUTHORIZATION OF DISCHARGE INTO THE SEA GRANTED TO THE INSULAR WATER COUNCIL OF TENERIFE (Expte. 2020/015), on it was already promoted from the Area of Hydraulic Infrastructure modification for an amount amounting to 48.49% of the Award Budget ( IGIC not included), as justified in the Reasoned Economic Technical Report-proposal of April 7, 2022. Since the modifications not foreseen in the PCAP of the contract for additional services to those initially contracted cannot suppose an alteration of its amount that exceeds 50% of the initial price of the contract in accordance with what is determined in article 205 of Law 9/2017, of November 8, on Public Sector Contracts, it is not possible to carry out the proposed work under new modifications not foreseen in the framework of the Expte. 2020/015, so this proposed recruitment report is being processed.
