1. The object of the contract is: the purchase of electricity for the purposes of the Entities forming part of the Purchasing Group (formed by the City of Jasło on the joint conduct of public procurement proceedings for the purchase of electricity). The City of Jasło as an Entity authorized to conduct the procedure and award the contract on behalf of and for the benefit of all Entities — members of the Purchasing Group will determine the Contractor of the unrestricted tender. The Contracting Authority shall allow the signing of the contract by correspondence.
2. Purchase of electricity does not include the provision of electricity distribution service.
3. Purchase of electricity will be carried out under the conditions laid down in the Act — Energy Law of 10 April 1997 (Journal of Laws of 2021, item 716. of the end), the implementing provisions of that Act, and in particular the Regulation of the Minister of Economy of 21 August 2008 in the on the detailed conditions for the functioning of the system

Purchase of electricity will be carried out under the conditions laid down in the Act — Energy Law of 10 April 1997 (Journal of Laws of 2021, item 716. of the end), the implementing provisions of that Act, and in particular the Regulation of the Minister of Economy of 21 August 2008 in the on specific conditions for the operation of the electricity system (Journal of Laws 2008 No. 162, item 1005, as amended), Tariff for electricity distribution services of the relevant Distribution System Operator (TSO Tariff), Traffic Instructions and Operation of the Distribution Network (IRiESD) and commonly applicable legal rules.
4. Electricity demand according to the type of tariffs, the collection points describes in detail Annex 4 to the SWZ. After selecting the Contractor and signing the contract, the Contractor shall forward the documents (separate for each entity) for the notification of the Electricity Sales Agreement and updated the necessary data in the editable version — the Excel file.
5. Annex 4 to SWZ describes the aggregate statement of electricity needs according to operators and tariffs. The values of energy consumption indicated in Annex 4 to the SIWZ are accepted for the calculation of the estimated value of the contract, which does not reflect the actual use of electricity during the duration of the contract and cannot in any case be the basis for any claims by the Contractors. Actual settlements will take place on the basis of current indications of measurement and settlement systems for the supply of electricity in accordance with the Contractor's offer.
6. The estimated electricity demand during the contractual period for all entities included in the Purchasing Group is approximately 24,264 MWh for the period 2022-2023.
7. The Contracting Authority provides, in the framework of the implementation of this contract, an option right based on Article 441 (1) of the Act p.z.p. Through the law of option, the Contracting Party understands the possibility of executing the contract more broadly than stated in this proceeding. The right of option is the power of the Contracting Authority, which it may, but does not have to exercise in the implementation of this Agreement. The right of the option will be to increase the volume of the electricity ordered to 10% of the volumes indicated in Annex 4 to SWZ by placing an appropriate order by the Contracting Authority concerned.
8. Counters in facilities with tariff groups B21, B22, B23 are owned by the recipient and C11, C12A,
C12B, C21, are owned by PGE Distribution S.A.,
9. The entities and subordinates of the JST are not engaged in the resale of electricity.
10. Specific requirements for the items set out in Annex 4 to the SWZ:
For almost all points of collection, contracts are signed for the purchase of electricity for a fixed term, i.e. until 31.12.2021, and for distribution for an indefinite period.
11. It is anticipated that the amount of energy consumption points during the period of execution of the order may be increased or reduced (max 10% of the basic volume), e.g. with newly built street lighting, lighting of skvers and illuminations of buildings and walls, as well as newly constructed or acquired facilities or buildings, etc., the Contractor will be required to provide energy to the facilities set out in Annex 4 to the SWZ and to new pre-emptive points to be built and connected to the grid.
