Order to sell real estate by organizing online bids.

The city council, OCMW HA and AGBS HA wish to sell a number of real estate on demand and to realize this from a point of view of good governance. To this end, we are looking for a partner who is able to reach the market in the widest possible way through the intervention of real estate agents. For this reason, the contracting authority wishes to organise the sale via an electronic bidding system, which guarantees the widest possible survey of the prospective buyers, whereby a bid is possible between the different candidates.

This assignment concerns a framework agreement (Art. 2, 35° and Art. 43 of the Law of 17 June 2016) with a single participant, for the duration of 3 years, but can be terminated annually. The agreement is characterized by the fact that one does not know in advance the size or quantity of the quantities to be ordered that will be awarded within the framework of this contract. The precise orders (via the contracts resulting from the framework agreement) will be made in function of the needs of the contracting authority.

In the event that the contracting authority decides to place a precise order with the tenderer, in particular to offer a particular property for sale through the tenderer's electronic bidding system, this contract will be exercised exclusively by the tenderer.

The services are characterized by the principle that the full fee of the contractor, subject to any costs for the composition of the sales file, is paid by the purchaser of the property and therefore not by the contracting authority.

When the property is offered for sale via the electronic online bidding system, the price stated in the estimate report will be the minimum set price. If no offer is made that is equal to or higher than that setting price, the property will not be sold.

If the highest bid is equal or higher than the setting price, the allocation will be submitted to the deliberating body for approval.

Based on that decision, the authentic deed will become past after the expiry of the supervisory period.
