Description:
Management of bio-waste constituting municipal waste from real estate inhabited in the Rokietnica Commune

Management of bio-waste constituting municipal waste (biodegradable waste) collected as part of the selective collection of municipal waste from real estate inhabited in the area of the municipality of Rokietnica in the period from the date of signing the contract (not earlier than from 1 January 2023 to 31 December 2023; The Contractor will be obliged to systematically accept the waste being the subject of the contract from the entity providing the service of collection of the waste in question to the Municipality of Rokietnica.

The scope of the subject of the contract includes a fraction of bio-waste constituting municipal waste with the code

20 02 01 (biodegradable waste) with an estimated amount of 2500 Mg. The maximum amount of waste shall not exceed 3 000 Mg.

2. The Contractor undertakes to ensure the management of the actual amount of bio-waste collected as part of the selective collection of municipal waste from residents of the Rokietnica commune during the period of performance of the subject of the contract.

3. The Ordering Party reserves that the data provided are estimates, and their number to be collected may ultimately change (increase or decrease). Failure to complete the order in full by the Ordering Party, in the case of collection of waste in a smaller amount than the quantity specified above, may not be the basis for financial claims of the Contractor, demanding payment of remuneration or compensation.

4. The Ordering Party informs that bio-waste constituting municipal waste collected as part of selective collection of municipal waste from residents of the Rokietnica Commune is collected in waste containers without the use of bags.

The person receiving the waste on behalf of the Contractor shall be obliged to verify the conformity of the type and code of waste at the time of receipt of waste from the Contractor and confirm its acceptance by the BDO Waste transfer card.

Whenever the Ordering Party uses waste codes, it is appropriate to mean the codes contained in the Climate Minister's Regulation of 2 January 2020 on the Waste Catalogue (Journal of Laws 2020, item 10).

5. The Contractor is obliged to:

(a) assurance that is compliant with the requirements of the Waste Management Act in Recovery (R) or Disposal (D) processes;

(b) handling waste in a manner consistent with the waste management hierarchy;

(c) the provision of municipal installations/municipal installations in which/the processing of municipal biowaste will occur taking into account the principle of proximity, i.e. compliance with the principle that waste must be transmitted, taking into account the hierarchy of ways of handling waste, and the best available technique referred to in Article 207 of the Law of 27 April 2001. Environmental Law (uniform text of the Journal of Laws of 2021, item 1973 as amended) or the technology referred to in Article 143 of that Act, to the nearest places where they can be processed,

(d) provide for municipal installations/municipal installations with processing capacity allowing for the use of waste covered by this contract,
