1. The subject of the order is the gradual delivery of medicines according to the description of the subject of the order, in the assortment and quantities shown in detail on the price form - Annex 3 of the Terms of Reference divided into 34 parts hereinafter referred to as "packages".
2. The amounts indicated in the price form (Annex 3 to the ToR) are approximate values adopted for the purposes of comparing offers and selecting the best offer. At the same time, the Employer guarantees that the minimum amount of performance of the subject of the contract will be 75% of the amount indicated in the price form.
3. It is required that the expiry date of delivered medicines is not less than 6 months from the date of delivery to the Ordering Party. The Employer will allow a shorter validity period for the subject of the contract, however only in justified cases and after obtaining the consent of the Employer.
4. The medicines offered must have a marketing authorization and use in Poland issued by an authorized body, in accordance with the Act of 6 September 2001 Pharmaceutical Law ...
