The subject of the contract is the purchase for the needs of the Agency for Restructuring and Modernization of Agriculture (hereinafter referred to as the "Ordering Party") brand new, without signs of use or damage 74 pcs. computer servers (hereinafter: "IT Hardware") with management and diagnostic software (hereinafter referred to as "Software"), support and warranty service for a period of 36 months, meeting at least the technical and functional parameters described in Appendix No. 1 to the draft provisions of the contract together with the annexes constituting Annex 7 to the tender specifications (hereinafter: "SWZ").

1. The subject of the contract is the purchase for the needs of the Agency for Restructuring and Modernization of Agriculture (hereinafter referred to as the "Ordering Party") brand new, without signs of use or damage 74 pcs. computer servers (hereinafter referred to as: "IT Hardware") with management and diagnostic software (hereinafter referred to as "Software"), support and warranty service for a period of 36 months, meeting at least the parameters and functionalities described in Annex 1 to the draft provisions of the contract (hereinafter: PPU) together with attachments constituting Annex 7 to the specification of the terms of the contract (hereinafter: "SWZ").

2. The Ordering Party requires delivery of 40 pcs. servers (Datacenter) of two types (A – 36 pcs. and B – 4 pcs.), which will work in two basic data processing centers of the Ordering Party - located in Warsaw and Piaseczno and 34 pcs. servers (ROBO) for data centers located in the Regional Districts indicated in the List of Locations contained in Annex 3 to the PPU.

3. The Contractor shall deliver, install, configure and launch the IT Equipment with the Software in accordance with the specification and ensuring at least the functionalities referred to in Annex 1 to the PPU.

4. The Contractor shall provide the Ordering Party with a warranty service for IT Equipment together with the Software for a period of 36 months from the date of signing the Implementation Protocol without reservations by the Ordering Party, including providing the manufacturer's support (Service Care) by issuing an appropriate document to the Ordering Party, confirming the right to access the manufacturer's support in the above-mentioned period, in accordance with the manufacturer's general terms and conditions.

5. The Contracting Authority requires that the performance of the subject of the contract takes place on the terms and conditions specified in the PPU together with
