Description:
Development of a multi-brand and multi-variant concept together with a profit. The final decision of the DUŚ for Kocmyrzowska Street from the intersection from Bulwarowa Street to Grębałów node in Krakow is implemented by GDDKiA by GDKiA

1. The object of the order is a service consisting of the development of a multi-brand and multi-variant concept of the extension of Kocmyrzowska Street from the junction with Bulwarowa Street to Grębałów junction, together with the necessary technical infrastructure and obtaining a final decision on environmental conditions.

2. The procedure is carried out in an unlimited tender procedure, pursuant to Article 132 of the Law of 11 September 2019 - Public Procurement Law (Journal of Laws 2019, item 2019, item 2019, hereinafter referred to as the “Pzp Act”).

The object of the order is a service consisting of the development of a multi-brand and multi-variant concept of the extension of Kocmyrzowska Street from the junction with Bulwarowa Street to Grębałów junction, together with the necessary technical infrastructure and obtaining a final decision on environmental conditions.

2. A detailed description of the subject matter of the contract and the scope of the Contractor's responsibilities are set out in the Annexes to the SWZ, including, inter alia, the Designed Agreement Terms (PPU) and the Description of the Object of the Order (OPZ)

3. Subject of the order according to the Common Procurement Dictionary (CPV): 71240000-2 Architectural, Engineering and Planning Services.

4. The Contracting Authority shall, in accordance with Article 139 (1) of the Pzp Act, provide for an inverted order of activities, i.e. first to examine and evaluate tenders, and then to make the subject qualification of the Contractor whose offer has been the highest rated, in the absence of grounds for exclusion and fulfilment of the conditions participation in the proceedings. Due to the application of the above procedure, the Contracting Authority does not require the submission of a declaration in the form of a Single European Procurement Document (JEDZ) with the offer. The Contracting Authority shall request that this statement be made only from the Contractor whose offer has been rated at the highest.

6. The Contractor is obliged to complete the subject of the contract within 19 months from the date of conclusion of the contract. The Contractor shall be obliged to carry out the subject of the contract, subject to the intermediate dates specified for the individual stages of the contract. Detailed dates for the execution of the subject of the contract are set out in §7 of the Designed provisions of the contract (including No. 1 to SWZ).

7. The Contracting Authority provides for the award of the contracts referred to in Article 214 (1) (7) of the Pzp Act, in accordance with its subject matter constituting a repeat of the similar object of the contract, up to 20,44% of the estimated value of this contract. The Contracting Authority provides for a period of 3 years from the date of award of the basic contract the possible conclusion of contracts for similar services and the determination of the Contractor's remuneration will occur after prior negotiations with the Contractor (prices may not exceed average market prices in the given half-year).

8. The Contracting Authority does not require that persons participating in the execution of the contract be employed by the Contractor or Subcontractor under an employment contract within the meaning of the provisions of the Act of 26 June 1974 — the Labor Code.

9. The Contracting Authority shall not require the Contractors to submit the measures of evidence in question.

10. The Ordering Party does not require the insertion of a defect.

11. Prior to the conclusion of the contract, the Contractor whose offer has been considered to be the most advantageous shall provide a security for due performance of the contract at 5% of the total price stated in the offer.

12. Information obligation arising from EP and Council Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation ) — is described in Section XXII of the SWZ.

13.
