Hiring third parties Region West-Brabant 2022

The purpose of the tender is to enter into a framework agreement with three service providers for lot 1 (temporary employment and secondment), and with one service provider for lot 2 (payroll services and self-employed contract management).

Plot 1: Broadcasting and Posting

The organisations participating in this tender intend to conclude a framework agreement together with three external service providers for the agreed duration, with an effective date of 1 January 2023. The director of the West Brabant Region signs the framework agreements on behalf of the participating organisations.

Lot 2: payroll services and self-employed contract management

The organisations participating in this tender intend to conclude 1 (one) framework agreement together with a payroll service provider for the agreed duration, with an effective date of 1 January 2023. The director of the West Brabant Region signs the framework agreement on behalf of the participating organisations.

Hiring flexible labour (temporary employment and secondment)

Lot 1 concerns the hiring (temporary employment/secondment) of temporary employees for positions up to and including scale 7/8. It concerns for 75%/ 80% administrative support, KCC employee and policy support functions within (municipal) organizations up to a maximum MBO + level and 20%/ 25% loaders and drivers for the Waste Service.

If the duration of the hiring contract depends on the duration of the assignment, it is broadcasting. The employment contract also ends when the temporary worker reports sick, in addition, the temporary worker can resign at any time. This often involves temporary replacement of own staff and/or extra capacity to support one's own staff.

Assign

If the Contractor and/or client finds it desirable to bind the hiring for a longer period of time, a secondment agreement will be entered into instead of a temporary employment agreement. There is no temporary employment clause between the temporary worker and the temporary employment agency. This means that the temporary worker has an employment contract that does not automatically end if the hirer terminates the assignment or if the temporary worker calls in sick. The temporary worker also has a notice period.

Payroll services and self-employed Contract Management

The assignment concerns the execution of services with regard to payroll services and self-employed contract management. For this purpose, the Clients conclude a framework agreement with one party.

Payroll exists if the payroll organization makes employees available flexibly, this can be done on a billable or contract hours basis. The Client carries out the recruitment and selection itself. The payroll organization is a legal employer while the employee is under the direction and supervision of the Client. Payroll is carried out in accordance with the guidelines of the Balanced Labour Market Act (W.A.B.).

For the proposed freelancers, contract management must be carried out in accordance with Act D.B.A..

Clients reserve the right to set up self-employed contract management themselves and, where appropriate, not to nominate freelancers.

Invoicing takes place by means of the rwb's business management package.
