"Development of investment areas. for an industrial function in the northern part of the City of Słupsk" in accordance with the Functional and Utility Program along with obtaining the necessary conditions, opinions, arrangements, checks, provisions, expert opinions, measurements, decisions of the administrative. related to the performance of of the item order.
According to the application for dofin. from the Government. Fund Polish Deal is planned to be implemented. roads connecting the area with the county road. no. 1015G and DK no. 21, construction and modernization of roads inside the industrial zone along with the necessary technical infrastructure. road and construction of water, sewage and power networks.
As part of the task, multi-discipline project documentation should be made. regarding the intention of buildings. and perform construction works regarding the construction project and perform construction works regarding the comprehensive development of investment areas. under the function of industry. in the northern part Slupsk.
1. The subject of the contract includes in particular:
1) development of design and executive documentation for the development of investment areas for industrial function in the northern part of the City of Słupsk on the basis of PFU along with obtaining a decision on the permit for the implementation of a road investment (ZRID) and any other administrative decisions, arrangements and opinions necessary to carry out the investment task, in accordance with applicable regulations, it is necessary to conduct proceedings aimed at issuing a water permit, environmental decision, including (if necessary) the preparation of an information sheet of the project and/or an Environmental Impact Report,
2) execution of construction works on the basis of the obtained decisions of the administration, referred to in point 1 of point and the project documentation. executed by the Contractor together with the notification of completion of construction works / occupancy permit in the appropriate construction supervision,
3) providing technical staff with qualifications/authorizations appropriate to perform all elements falling within the scope of the contract for the duration of the contract.
2. The Contracting Authority informs that the PFU is not an exhaustive document in terms of all requirements and the aforementioned provisions and the Contractor should take this into account when preparing the project documentation. The PFU may not cover all the details necessary for the studies. project documentation. The contractor may not use any errors or omissions in the PFU to evade the implementation of project documentation. in accordance with applicable law and proper execution of works.
3. In the design and construction of lighting, luminaires should be used, the control system of which is compatible with the Reva Siled–SILED CMS control system used by ZIM in Słupsk.
4. The Ordering Party requires at least a 10-year manufacturer's warranty for installed luminaires and steel poles with booms.
5. The Contracting Authority requires the Contractor to provide a guarantee for the executed subject of the contract for a period of not less than 36 months from the date of final acceptance.
6. The Ordering Party requires the Contractor to provide a warranty for defects for the subject of the contract for a period of 60 months, from the date of final acceptance.
7. The Contracting Authority shall require that the fleet used by the Contractor for the performance of the contract contains at least 10% of vehicles powered by electricity or natural gas.
8. The Contractor must hold third party liability insurance throughout the duration of the contract in the scope of its business activity, including damage caused in connection with the implementation of the subject of the contract.
9. The conditions contained in the initial promise Edition5RSP/2022/351/PolskiLad are described in the project. agreements, including: payment of co-financing in two tranches – the first after the completion of a separate stage of works as part of the investment, the second – after the completion of the investment:
1) the first tranche in the amount not higher than 50% of the co-financing amount,
2) the second tranche in the amount of the remaining amount of co-financing.
10. The Contractor, in accordance with the terms of the Initial Promise, shall provide financing of the investment in the part not covered by the Employer's own contribution, for the time preceding the payment from the Promise, on the terms set out in the project. Agreement.
11. The Contracting Authority and the Contractor undertake to submit any disputes in the relations
civil law claims in cases in which the conclusion of a settlement is admissible, mediation or other amicable settlement of a dispute before the Court of Arbitration at the General Counsel of the Republic of Poland, a selected mediator or a person conducting another amicable dispute resolution.
12. Disputes that cannot be resolved amicably, arising in the context of the performance of this order (contract) shall be settled by a common court competent for the seat of the Ordering Party.
13. The subject of the contract is described in detail in the procurement documents. The conditions for the execution of the contract are indicated in the project. agreement –appendix no. 9 to SWZ.
