1. The subject of this contract is the supply of electricity to the facilities of the Contracting Authority – the Municipality of Andrespol and the organizational units of the Municipality of Andrespol indicated in Appendix No. 1 to the Terms of Reference, in the period from 01.01.2024 to 31.12.2024 in accordance with the provisions of the Act of 10 April 1997. Energy Law, the Civil Code and executive acts issued on their basis.
2. The Contracting Authority acts on its own behalf and is entitled to conduct the tender procedure on behalf of the organizational units of the Municipality of Andrespol.
3. The Municipality of Andrespol and its organizational units will conclude separate agreements resulting from this procedure for the award of a public contract in an open tender procedure for the supply of electricity to the facilities of the Contracting Authority and organizational units of the Municipality of Andrespol.
4. A detailed description of the subject matter of the contract is included in Appendix No. 1 to the Terms of Reference entitled "Description of the subject matter of the contract - Supply of electricity"
1. The subject of this contract is the supply of electricity to the facilities of the Contracting Authority – the Municipality of Andrespol and the organizational units of the Municipality of Andrespol indicated in Appendix No. 1 to the Terms of Reference, in the period from 01.01.2024 to 31.12.2024 in accordance with the provisions of the Act of 10 April 1997. Energy Law, the Civil Code and executive acts issued on their basis.
2. The Contracting Authority acts on its own behalf and is entitled to conduct the tender procedure on behalf of the organizational units of the Municipality of Andrespol.
3. The Municipality of Andrespol and its organizational units will conclude separate agreements resulting from this procedure for the award of a public contract in an open tender procedure for the supply of electricity to the facilities of the Contracting Authority and organizational units of the Municipality of Andrespol.
4. A detailed description of the subject matter of the contract is included in Appendix No. 1 to the Terms of Reference entitled "Description of the subject matter of the contract – Supply of electricity", which is an integral part of this Terms of Reference.
5. The estimated demand for electricity to the facilities in the period from 01.01.2024 to 31.12.2024 is 2,357,421 kWh.
6. The Contracting Authority declares that:
(1) The procedure for the selection of the electricity supplier in the form of a tender shall take place once again.
2) Concluded an agreement for the sale of electricity with GREEN Spółka Akcyjna, 27/2 Naruszewicza Street, 02-627 Warsaw, for the sale of electricity for PPE in the Cxx and Gxx tariffs – agreement concluded for a definite period of time, until 31.12.2023.
3) Concluded 2 comprehensive agreements for the sale of electricity and the provision of distribution services with PGE Obrót SA, 6 8 Marca Street, 35-959 Rzeszów, for the sale of electricity for the Employee Pension Plan in the B22 tariff – agreement concluded for a definite period of time, until 31.12.2023.
4) The forecast of energy consumption indicated above and in the Description of the subject of the contract is only an approximate value, which may change during the performance of the contract. The actual energy consumption (lower or higher than the forecast indicated in Appendix 1 to the Terms of Reference) will depend solely on the actual needs of the Contracting Authority, and the Seller is obliged to apply the energy prices offered in the tender in each case;
5) Concluded agreements for the provision of distribution services with the Distribution Network Operator: PGE Dystrybucja S.A. for an indefinite period of time, which is the distributor of electricity in the Andrespol Commune;
6) The Contractor selected in the procedure will be provided with data on the EPP in electronic form (MS Excel file);
7) Agrees to conclude the agreement by correspondence.
7. The estimated demand for electricity is only indicative, used to compare offers and in no case constitutes an obligation on the part of the Contracting Authority to purchase energy in the specified amount.
8. The Contractor may not pursue any financial claims (e.g. damages) from the Contracting Authority if, during the term of the contract, the Contracting Authority purchases from the Contractor a smaller or larger amount of electricity than forecast, indicated in the description of the subject of the contract - Appendix No. 1 to the Terms of Reference.
9. The energy supplier is obliged to have a distribution agreement concluded with the Distribution System Operator (DSO) competent for the Contracting Authority's facility, no later than on the date of conclusion of the agreement concerning the contract in question and for a period not shorter than until 31.12.2024.
10. The Contractor undertakes to provide the Contracting Authority with service quality standards in accordance with the applicable provisions of the Energy Law.
11. The Contractor will be obliged to act as the entity responsible for commercial balancing for electricity sold under the subject of the contract.
12. The subject matter of the contract does not include the provision of electricity distribution services, and the electricity distribution services will be provided on the basis of separate agreements concluded by the Contracting Authority with the relevant Distribution System Operator – DSO data are included in Appendix 1 to the Terms of Reference.
