The proceedings shall be carried out by means of an unrestricted tender pursuant to Article 129 (1), referred to as Article 129 (2) and Articles 132 to 139 of the Law of Public Procurement (text: Journal of Laws of 2021, item 1129, as amended - “PZP”) and the implementing acts of the PZP. The proceedings shall be carried out in accordance with the rules laid down for the so-called 'reverse procedure' referred to in Article 139 (1), 3-4 of the PZP.

The subject of the contract is forest management services as defined in Article 6 (1) (1) of the Act of 28 September 1991 on forests (text: Journal of Laws of 2021, item 1275, as amended — 'Forests Act') covering work on forest farming, forest nursery, seed and seed work selection, forest protection, fire protection, logging and breaking timber, side use of the forest and other forest management work, to be carried out in the area of the Kościerzyna Forest District in 2022.

The subject of the contract shall cover the work of forest farming, forest protection, fire protection, logging and breaking of timber, side use of the forest and other forest management work resulting from Annex 3 to the Specification of the Terms of Order, hereinafter referred to as' SWZ ', which consists of Annex No 3.1. — the size of work by group of activities, activities and location, Annex No 3.2. — timber collection sortyment system, Annex No 3.3. — statement of the distances and conditions of the lumber spun, Annex No 3.4. A statement of items not made available for machine sourcing, Annex No 3.5 . - information about the use of possible logging technologies, compound.3.7 - information about the slowing of the supplied seedlings at the planting site (working surface), part 3.8. - list of surfaces where the protection of raids is planned. In kind ranges collated in z. 3.1.-3.3. and 3.5., 3.6, 3.8. SWZs are of an estimation nature. A detailed description of the technology for carrying out individual forestry works and the procedure for receiving them are included in Annex No 4 of the SWZ. Descriptions of the action codes describing each work are described in Annex 4 to SWZ.

The Contracting Authority shall require employment by the Contractor or subcontractor on the basis of the contract of employment of persons performing the activities part of the subject of the contract involving the acquisition and retraction of the wood raw material, if the performance of these activities consists in the performance of the work in the manner laid down in Article. 22 § 1 of the Act of 26 June 1974 — Labor Code (text: Journal of Laws of 2020 item 1320 as amended).

The services relating to the collection and retraction work referred to in point 3.1. SWZ, they will rely on the execution of logging and ripping of wood based on two technologies:

(a) using timber harvesting and wood sawing saws and for retracting of agricultural tractor, specialised (pluck), forwarders or (i) tractors adapted for retractable timber, equipped with cranes for loading and unloading wood;

(b) using timber collection and wood sortyments of harvesters (multi-operational) wood-harvesters, and for breaking forwarders or (i) tractors adapted to rearward timber, equipped with cranes for loading and unloading wood (wood rip).
