This assignment aims at a partnership with one contractor for the leasing of electric bicycles, the associated services, i.e. roadside assistance, periodic maintenance, repairs, insurance against theft and damage and legal assistance and the provision of a sturdy and solid double pannier per leased bicycle.

The envisaged agreement is a framework agreement that creates a contractual framework with regard to the establishment of conditions of individual sub-contracts that will be awarded during the specified period. The termination of the framework agreement, at the end of the term, shall not lead to the termination of the partial contracts concluded within the framework agreement. The partial assignments remain in force until the end of their own term. The other provisions shall be governed by those of the framework agreement.

The intended framework agreement for the supply of bicycles and the associated services and panniers is concluded for a period of 48 months. The duration of the leasing of the bicycles, the partial assignments within the framework of the concluded framework agreement, is always for a period of 36 months. As a result, individual lease contracts concluded in the last year of the framework agreement must be respected, so that the total term of the agreement can be up to 7 years. After the leasing period, there must be the possibility to buy the bicycle from the contractor.

This order is an on-demand order, the quantity being specified later. The contractor undertakes to deliver all ordered quantities. This quantity shall be determined in function of the actual need at the time of performance of the contract. The individual calls are made on the basis of a pre-chosen order form and the contractor receives the formal right to deliver exclusively on the basis of this order form.

The contractor undertakes to be able to deliver the bicycles specified in his offer from the award until the end of the contract. In the event of a possible product modification, an equivalent product will be delivered under the same conditions as in the original agreement, including the price. The equivalent product also meets the same technical specifications, or better, as specified in the specifications.

The contractor undertakes to always supply high-quality bicycles. If it is determined that the quality of some bicycles is poor or insufficient or if defects are found, the contractor must immediately take back these products and immediately replace them with the correct quality (free of charge).

There are currently about 200 electric bicycles in use within Familiehulp. The expected quantity to be purchased during the 48 months of this new framework agreement will amount to about 300 bicycles with associated services and panniers. These are probable quantities, based on the current numbers, and these are purely indicative. They do not bind the contracting authority in any way. The contractor cannot claim compensation if these probable quantities are not reached.

Delivery place:

The bikes must be able to be delivered to various places throughout Flanders and in Brussels. The delivery addresses will be communicated by the contracting authority to the contractor for each sub-contract.
