The subject of the contract is services in the field of forest management as defined in Article 6 (1) point 1 of the Act of 28 September 1991 on forests (text one: Journal of Laws of 2021 item 1275 as late as “Forests Act”) covering works in the field of forest breeding and protection, fire protection, obtaining and ripping timber, tourist development, to be carried out in the Przedborów Forest District in the year 2022.

The procedure shall be conducted under unlimited invitation to tender pursuant to Art.129 (1point 1) in Article 129 (2) and Art.132-139 of the Act of 11.09.2019 Public Procurement Law and Implementing Acts to the PZP. The procedure shall be carried out in accordance with the rules laid down for classical procurement with a value equal to or exceeding Union thresholds.

The procedure shall be carried out in accordance with the rules laid down for the so-called 'reverse procedure' referred to in Article 139 (1), (3) to (4) of the PZP.

The detailed description of the standard of technology for the performance of individual forestry works (activities) included in the subject of the contract formed the basis for the determination of the quality requirements relating to the elements consisting of the object of the contract contained in the Annex No. 4 to SWZ

The scope of the subject matter of the contract shall include the total quantities of works in the field of forest farming and protection, fire protection, harvesting and plucking of timber, tourist development resulting from Annex 3 to the SWZ, which consists of:

Annex No 3.2. — timber collection sortyment system;

Annex No 3.3. — a statement of the distances and conditions of breaking wood;

Annex No 3.4. — a statement of items not made available for machine acquisition;

Annex 3.5. — information on the use of possible logging technologies;

The material ranges set out in Annexes No 3.1. - 3.3. and 3.5. are estimated.

Qualitative standards relating to all relevant features of the subject of the contract are determined by Decision No 19 of the Director General of State Forests of 17 March 2021 on the introduction of the “Description of the standard of forest work performance technology” in the organisational units of the Forests State. The detailed description of the standard of technology for the performance of individual forestry works (activities) included in the subject of the contract formed the basis for the determination of the quality requirements relating to the elements consisting of the object of the contract contained in the Annex No 4 to SWZ (Description of the standard of technology for the implementation of forestry works).

The Contracting Authority in accordance with Article 95 of the PZP shall require employment by the Contractor or subcontractor on the basis of the working relationship of persons performing the procurement and retraction of the wood material, if the performance of these activities consists in the performance of the work in the manner of referred to in Article 22 (1) of the Act of 26 June 1974 - Labour Code (text: Journal of Laws of 2020 item 1320 as amended).
