1) The subject of this order is the purchase of electricity for the Ordering Party's facility: AQUARIUM Centrum Fit Rawa (address: Katowicka 20, 96-200 Rawa Mazowiecka) in the period from 01.01.2023 to 31.12.2023 in accordance with the provisions of the Act of 10 April 1997. Energy Law (i.e. Journal of Laws of 2021, item 716, as amended), executive acts issued on its basis, the Civil Code and Annex No. 1 to the SWZ. 2) The estimated demand for electricity for the Ordering Party's facility in the period from 01.01.2023 to 31.12.2023 is 1 300 000 kWh.

1) The subject of this contract is the purchase of electricity for the Ordering Party's facility: AQUARIUM Centrum Fit Rawa (address: Katowicka 20, 96-200 Rawa Mazowiecka) in the period from 01.01.2023 to 31.12.2023 in accordance with the provisions of the Energy Law Issued on its basis by implementing acts, the Civil Code and Annex No. 1 to the SWZ. 2) The Contractor will be obliged to ensure the quality standards of the Ordering Party's service in accordance with the applicable provisions of the energy law. It should ensure round-the-clock continuity of supply without any interruptions in supply, except for the situations described in the Energy Law, IRiESD, tariff and have a reserve guaranteeing the continuity of supply. 3) The Ordering Party declares that:a)the procedure for selecting the electricity supplier in the form of a tender takes place once again;b)for the AQUARIUM Centrum Fit Rawa facility, it has concluded a contract for the sale of electricity with Orange Energia Sp. z o.o., valid until 31-12-2022 and a distribution service agreement with PGE Dystrybucja SA for an indefinite period;c) the PPE metering and settlement system in the C23 tariff is adapted to the TPA principle; d) the Contractor selected as a result of the proceedings will provide ppE data in the form of an MS Excel file. 4) The estimated demand for electricity for the Ordering Party's facility in the period from 01.01.2023 to 31.12.2023 is 1 300 000 kWh - Attachment. No. 1. The amount of electricity purchased during the term of the contract will not be less than 950,000.00 kWh. 5) The demand for electricity was assumed on the basis of historical electricity consumption and may differ from the actual use of electricity, because it is not possible to determine in advance the amount of electricity that will be consumed by the Ordering Party. 6) The estimated demand for electricity is only indicative, used to compare offers and in no case constitutes an obligation on the part of the Ordering Party to purchase electricity in the given quantity. The amount of electricity consumed by the Ordering Party will be determined on the basis of direct readings of the measurement and settlement system. 7) The Contractor shall not be entitled to any claim for failure of the Ordering Party to collect the estimated amount of energy. 8) The Energy Supplier is obliged to have a distribution agreement concluded with the Distribution System Operator (DSO) competent for the Ordering Party's facility, at the latest on the date of conclusion of the contract regarding the order in question, for a period not shorter than until 31-12-2023. 9) The Ordering Party declares that the energy consumption forecast indicated above and in Appendix No. 1 to the SWZ is only an approximate value that may change during the performance of the Agreement. The actual consumption of electricity (smaller or higher than the forecast indicated in Appendix No. 1 to the SWZ) will depend only on the actual needs, but regardless of the volume of consumption, the Seller is obliged in each case to apply the electricity prices offered in the proceedings. The Contractor may not assert any financial claims from the Ordering Party (e.g. compensation) if, during the term of the contract, the Ordering Party purchases from the Contractor a smaller or larger amount of electricity than forecasted, indicated in Appendix No. 1 to the SWZ, in particular caused by an increase or decrease in the number of PPE or technical parameters of PPE. 10) The Contractor will be obliged to act as an entity responsible for commercial balancing for electricity sold under the subject of the contract. 11) The subject of the contract does not include the provision of electricity distribution services, and electricity distribution services will be provided on the basis of separate agreements concluded by the Ordering Party with the relevant Distribution System Operator – DSO data are included in Appendix No. 1 to SWZ.
