Detailed description of the subject of the contract: constitutes the SWZ including Annex 7 to the SWZ
The subject of the contract are Services related to the collection and transport of municipal waste from the owners of real estate residing from the territory of the Municipality of Brzezina.Common Procurement Dictionary: 90500000-2 - Waste Services, 90513100-7 - Export services of household waste, 90512000-9 - Waste transport services, 90511300-5 - Garbage collection services, 34928480-6 - Waste and garbage containers and bins, 90511000-2 - Waste export services. Detailed description of the subject of the contract: constitutes Annex 7 to the SWZ.The Contracting Authority does not allow the submission of equivalent tenders.The contracting authority shall not divide the contract into parts and thus does not allow submission of partial tenders. Tenders not containing the full scope of the subject of the contract will be rejected. Reasons for not splitting the order into parts:The order can be fulfilled by one Contractor in full. Implementation of the contract for parts would involve double transport costs from each locality.Information on the variant offer referred to in Article 92 of the Polish National Policy Act. The Contracting Authority shall not allow the submission of variant tenders.The Contracting Authority shall specify the following requirements regarding the employment by the Contractor or the Subcontractor of persons performing the activities indicated by the Contracting Authority in respect of the performance of the contract on the basis of the contract of work:The Contracting Authority pursuant to Article 95 Section 1 of the Public Procurement Law requires employment by the Contractor or Subcontractor on the basis of the employment relationship of persons performing activities in the field of performance of the contract, if the performance of such activities consists in the performance of work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code (Journal of Laws of 2020, item 1320, as amended). Type of activities related to the execution of the contract, which are affected by the requirements of employment on the basis of the employment relationship by the Contractor or Subcontractor of persons performing activities during the execution of the contract are the driving of vehicles used for the execution of the subject of the contract, collection municipal waste, supervising the correct execution of the entire scope of the contract.
Means of verification of the employment of these people:The Contractor or the Subcontractor is obliged to document at each request of the Contracting Authority, no later than within 5 calendar days from the date of receipt of such a call, the fulfillment of the fact of employment of persons, by submitting to the Contracting Authority declaration that all persons performing the activities indicated in paragraph 1 were employed during the period of performance of the contract by the Contractor or the Subcontractor, as per the specified date, on the basis of an employment contract. This statement should contain: information, including personal data, necessary for verification of employment under an employment contract, in particular the name of the employed employee, the date of conclusion of the employment contract, the type of employment contract and the scope of duties of the employee.
Powers of the Contracting Authority to control compliance by the Contractor with the requirements related to the employment of these persons and sanctions for failure to comply with these requirements:
a) failure to submit within the time limit by the Contractor or the Subcontractor a statement confirming employment under the employment contract referred to in paragraph 2 will be treated as failure to fulfil the obligation to employ employees under the employment contract and will result in the calculation of a penalty the contractual amount specified in the proposed provisions of the agreement.
b) in case of doubt by the Contracting Authority that the Contractor or the Subcontractor does not employ persons designated in accordance with paragraph 2, the Contracting Authority reserves the right to notify the relevant services.
